The subject of the contract is to carry out measurements of Guaranteed Technical Parameters of groups A, B and C specified in the Functional and Utility Program applicable to the Contractor and to issue an opinion on the fulfillment of other requirements by the Installation, in accordance with the requirements set out in the SWZ.

Guaranteed parameters are divided into:

• guaranteed technical parameters of group A,

- Concentrations of air emission of standardized pollutant components in exhaust gases,

- Meeting the process condition of flue gas residence for 2 seconds at a temperature of ≥850°C.

- Organic carbon content (TOC) in slags and bottom ashes or proportion of combustible parts in slags and bottom ashes assessed according to ignition losses (LOI).

-Noise

• Guaranteed technical parameters of group B,

- efficiency of the Installation,

- electrical and thermal power,

- quality of the process of stabilization and solidification of post-process waste

• Guaranteed technical parameters of Group C (durability parameters).

- availability of the installation,

- the length of the maintenance interval,

- durability of the grate,

- durability of the lining of the furnace and afterburner chamber,

- durability of boiler heating surfaces,

- durability of bag filter sleeves.

• Other requirements for Installation

- efficiency of the slag valorization node

- efficiency of the stabilization and solidification unit of fly ash and solid residues from the flue gas cleaning process

- meeting the requirements of the BAT conclusions

- correctness of installation of continuous emission monitoring systems (including correctness of the QAL 2 procedure), correctness of installation of measuring connectors for periodic measurements of exhaust emissions

Measurements of Guaranteed Technical Parameters of Groups A and B and the efficiency of the slag valorization node and the fly ash stabilization and solidification node and solid residues from the flue gas cleaning process will be carried out during the 720-hour Test Run. The assessment of compliance with the Guaranteed Technical Parameters of Group C will be carried out annually during the Defect Reporting Period during the planned maintenance shutdown.

Order Scope

The basic scope of the Independent Institution's work is to develop and agree on the Guarantee Measurement Program, to carry out Measurements of Guaranteed Technical Parameters of Group A and B once, and to assess the guaranteed values on the basis of the obtained measurement results, along with the development of Measurement Reports along with providing detailed explanations for reservations, defects and doubts raised by the Parties to Contract No. 5. The Ordering Party may order the Measurements of Guaranteed Technical Parameters of Group A or separately the Measurements of Guaranteed Technical Parameters of Group B (or jointly for groups A and B or parts of the above-mentioned measurements). Such an order is provided for on the basis of a right of option.

The subject of the contract consists of the basic scope (Stage 1, Stage 2, Stage 3) and the scope covered by the option right (Stage 4) on the terms and conditions described in the Agreement.

The basic scope of work of the Independent Institution also includes:

- Assessment of compliance with the Guaranteed Technical Parameters of Group C – issued in the form of written opinions

- Opinion on the Acceptance Test Program developed by Contractor K5.

- Measurements of other parameters (efficiency of the slag valorization installation and ash stabilization installation)

- Opinion on the compliance of the implementation of the Installation with the requirements of the BAT conclusions

- Opinion on the correctness of the installation of continuous emission measurement systems and the correctness of the QAL 2 procedure, and opinion on the installation of measuring connectors for periodic exhaust emission measurements.

- Other necessary activities, analyses, arrangements, studies necessary and necessary for the implementation of the subject of the contract resulting from the provisions of Contract No. 5, including PFU and OPZ.
