The subject of the contract is the execution of the construction and implementation project together with the fulfilment of the copyright supervision for the task: “Expansion of the National Road No. 63 on the section of Giżycko—Miłki”

1) The item of the order is described in volumes II—III of SWZ.

2) The Contracting Authority reserves the obligation of the Contractor to perform the key tasks in person, i.e.:

(a) the activities carried out by the road designer, which are the duties of the designer under Article 20 of the Act, the building law and the provisions of the design specification;

(b) the following elements listed in the table of design studies and copyright surveillance activities: Table A: Lp. 4 — Construction project (road part), Lp. 5 — Executive project (road section).

As regards key tasks reserved for personal performance by the Contractor, he may not be relied upon by the capacity of the resource sharing entity, under the principles laid down in Article 118 (1) of the Pzp Act, to demonstrate the fulfilment of the relevant conditions of participation in the proceedings described in paragraph 8.2.4.1 and paragraph 8.2.4.2.1 IDW.
