The object of the order is to produce a durable asset in the “optimize-build” formula by building a network of television news channels buildings along with services, underground garage, accompanying infrastructure and landscaping, on the premises of the Main Television Department Polish S.A. at J.P. Woronia Street in Warsaw. The description of the object of the order includes Annex No 2 to SWZ, whose annexes 1 to No 5 (detailed description of the subject of the contract) the Contracting Party has granted a confidentiality clause, because the information contained therein is a secret to the Contracting Authority.

1.The object of the order is to produce a fixed asset in the “optimize-build” formula by building a network of TV news channel buildings together with services, underground garage, accompanying infrastructure and landscaping, on the premises of the Main Plant Polish TV S.A. at J.P. Woronia Street in Warsaw.

2.The description of the object of the order includes Annex No 2 to SWZ, whose annexes 1 to No 5 (detailed description of the subject of the contract) the Contracting Authority granted a confidentiality clause, because the information contained therein is a secret to the Contracting Authority.

3.Submission to the Contractor of Annexes No 1 to No 5 to the Subject Description of the Order will be possible after submitting a request to the Contracting Authority for the release of information constituting the secret of the undertaking, together with the Contractor's obligation to maintain confidentiality, constituting Annex 3 to the SWZ — called hereinafter 'Application', signed by a person duly empowered to represent the Contractor, which the Contractor is obliged to demonstrate when submitting the Applications in the manner indicated in point 4.4 of SWZ. The application must be drawn up and communicated in electronic form and scalded with a qualified electronic signature. The Contracting Authority shall not permit the submission of this document in any other form, e.g. written.

4.Pursuant to Article 18 (2) of the Pzp Act, the Contracting Authority informs that all information which the Contracting Authority has covered with a confidentiality clause and information closely related to it (e.g. clarification of SWZ content concerning confidential information) is considered confidential.

5.The confidentiality clause is covered by the Annexes No 1 to No 5 to the Subject Description of the Order, which constitute the secret of the undertaking. The method of transmitting the Annexes No 1 to No 5 to the Description of the Order Subject, constituting the secret of the enterprise and confidential information or information closely related to confidential information relating to the contents of the Annexes 1 to No 5 to the Description of the Order Subject, has been referred to in paragraphs 4.3-4.7 of SWZ.

6.Where, in the proceedings, the Contracting Authority transfers confidential information or information closely related to confidential information other than those indicated in point 20.2 of the SWZ, in order to maintain its confidentiality, it shall be transmitted to the Contractor in one of the following selected by the Contracting Authority ways:

6.1 in person at the premises of the Contracting Authority after prior appointment by the Contracting Authority of the specific place, date and time of receipt,

6.2 by the messenger to the address indicated by the Contractor,

6.3 via Platform.

7. The transfer of confidential information referred to in point 6 of the Contracting Authority may be subject to the completion of the relevant formalities by the Contractor (e.g. the signing of a confidentiality undertaking by a duly empowered representative of the Contractor). Where this information is communicated as specified in point 6, the provisions of paragraphs 4.5-4.7 of SWZ shall apply accordingly.
