1. The subject of this order is “The supply of electricity and the provision of electricity distribution services for the purposes of the operation of buildings, premises, commercial facilities, municipal equipment and for the supply of street lighting in the Lubaczów Municipality in period from 01.01.2022 to 31.12.2022' indicated in Annex No 1 to SWZ in accordance with the provisions of the Act of 10 April 1997. 1) The Municipality of Lubaczów and the units listed in Annex No 1 to the SWZ will conclude separate contracts resulting from this procedure for the award of a public contract by means of an unrestricted tender. Details of the conclusion of contracts are included in Annex 1 to SWZ. The duty of the selected Contractor shall be to notify the designated Distribution System Operator for the implementation of the Comprehensive Electricity Supply Agreement concluded with the Contractor, including the sale and provision of electricity distribution services.

2. Order — purchase and distribution of electricity to the facilities listed in Annex 1 to SWZ: Estimated electricity demand for the period from 01.01.2022 to 31.12.2022 is 1,958,500 kWh. The Contracting Authority reserves the ability to reduce or increase the amount of electricity ordered. The operator of the Distribution System is PGE Distribution S.A.

1. The Contracting Authority shall act on his own behalf and on the basis of the signed Agreement (Agreement for inspection at the office of the Contracting Authority), on behalf of the organisational units which are indicated in Annex 1 to the SWZ:

• Municipal Public Library

• Municipal House of Culture

For most of the collection points, Comprehensive Electricity Sales and Distribution Agreements are concluded with PGE Turnover S.A. for a fixed period until 31.12.2021.

3. The supply of electricity and the provision of distribution services will be carried out under the conditions laid down፦ in the Act - Energy Law of 10 April 1997 (Journal of Laws of 2021, item 716), the implementing provisions of this Act, and in particular the Regulation of the Minister of Economy of 4 May 2007 on the detailed conditions for the operation of the electricity system (Journal of Laws 2008 No. 162, item 1005 as amended), - Tariff for electricity distribution services relevant to the Distribution System Operator (TSO Tariff), - Traffic and Operation Instructions of the Network Distributive (IRiESD) and generally applicable laws. Electricity should meet technical parameters in accordance with the provisions of the Energy Law Act and the implementing regulations of this law and Polish Standards.

4. Settlements for the distribution of electricity will be based on current indications of measurement and billing systems according to the rates of charges arising from the Distribution System Operator Tariff.

5. The Contractor must have an agreement for the provision of electricity distribution services with the operator of the distribution system operating on the territory of the Contracting Authority.

6. Implementation of the above tasks will be based on the conditions laid down in the SWZ and the contracts signed. Each of the abovementioned units the Contractor will be responsible separately for the performance of the contractual benefit. Information on the existing Agreements and their periods of termination are included in the Detailed Subject Description of the Order.

7. The Contracting Authority does not require the submission of the means of evidence in question.

8. Ordering does not split the order into parts. Thus, the Contracting Authority shall not allow the submission of partial tenders referred to in Article 7 (15) of the Law Pzp.
