Description:
Purchasing Group. Comprehensive supply of natural gas in the period from 01.01.2024 until 31.12.2024

1. The subject of the contract is a comprehensive supply of gaseous fuel – supply of high-methane natural gas with the symbol E along with a distribution service. The projected amount of gaseous fuel is 79,226,566 kWh to 582 PPG, details in Appendix 1 to the Terms of Reference

The above data are indicative. The estimated size of the subject of the contract was determined on the basis of historical data (previous consumption in facilities). The contractor should take into account possible fluctuations in consumption. Reducing or increasing the amount of gas fuel does not entail any consequences for the ordering party (recipients), except for the need to pay for the actually consumed amount of gas and transmission services in accordance with the applicable DSO Tariff.

2. The proceeding covered PPGs in which customers are "subject to tariff protection", those referred to in Article 62b(1)(2) of the EP Act, and customers who are not covered by the protection of

The contractor should take into account possible fluctuations in consumption. Reducing or increasing the amount of gas fuel does not entail any consequences for the ordering party (recipients), except for the need to pay for the actually consumed amount of gas and transmission services in accordance with the applicable DSO Tariff.

2. Details of gaseous fuel consumption and distribution parameters in individual PPGs are described in Appendix 1 to the Terms of Use - List of PPG Collection Points.

3.The proceeding covered PPGs in which customers are "subject to tariff protection", i.e. customers referred to in Article 62b(1)(2) of the PE Act and customers who are not protected. In Appendix 1 to the Terms of Reference, the contracting authority indicated to which PPG the provisions of Article 62b apply and according to which percentage. Upon signing the contract with the contractor whose bid is selected as the most advantageous, the contracting authority (customers) will submit relevant Declarations of the recipient of gaseous fuels (pursuant to Article 62ba and/or Article 62bb of the EP Act) in accordance with the template set out in the Regulation on the protection of gas customers as expected for 2024. In view of the above, there may be differences between the content of the Statements submitted to the current agreements and the statements attached to the proceedings.

4.As a result of the outcome of the procedure, 28 contracts will be concluded.

5. Quality standards. The Contracting Authority informs that the quality standards for the supply of natural gas relating to all essential features of the subject matter of the contract are described and regulated:

1) The subject of the contract is the supply of high-methane natural gas through the distribution network of Polska Spółka Gazownictwa sp. z o.o. with specified quality standards in accordance with the applicable regulations, together with the transmission service. Supplies and distribution services provided under the comprehensive agreement will be performed under the conditions specified in the provisions of the EP Act and the implementing regulations to the Act and in accordance with the provisions of the DSO Tariff.

2) The quality parameters of gaseous fuels are regulated by the provisions of the Energy Law, executive acts, in particular the Regulation of the Minister of Energy of 15 March 2018 on the detailed rules for the formation and calculation of tariffs and settlements in trade in gaseous fuels, amended by the Regulation of the Minister of Energy of 22 September 2019 amending the Regulation on the detailed rules for the formation and calculation of tariffs and settlements in trade in gaseous fuels (consolidated text Journal of Laws of 2021, item 280), Regulation of the Minister of Economy of 2 July 2010 on the detailed conditions for the operation of the gas system amended by the Regulation of the Minister of Climate and Environment of 6 August 2022 amending the Regulation on the detailed conditions for the operation of the gas system (Journal of Laws of 2022, item 1899) and Polish Standards.

3) Tariff for gaseous fuel distribution services

6. The Contracting Authority reserves the right to use Article 139(1) of the Public Procurement Act, i.e. the right to first examine and evaluate bids, and then to qualify the contractor whose bid has been rated the highest, in terms of the lack of grounds for exclusion and the fulfilment of the conditions for participation in the procedure.

7. The Contracting Authority requires the payment of a tender deposit in the amount of PLN 300,000.00
