The subject of the contract is the delivery of medical equipment with assembly to the Central Sterilization Unit SPZOZ in Łęczna and training of 8 staff on site at the Ordering Party. The subject of the order is described and specified in Annexes 3.1 to 3.2 (appropriate for the offered set) constituting the Specification of technical parameters

1. The subject of the contract is the delivery of medical equipment with assembly to the Central Sterilization Unit SPZOZ in Łęczna and training of 8 staff on site at the Ordering Party. The subject of the contract has been described and specified in Annexes No. 3.1 to 3.2 (appropriate for the offered set) constituting the Specification of technical parameters, CPV main code: 33191100-6 - Sterilizing devices

The equipment is divided into 2 sets:

Set No. 1 – Steam Sterilization 33191100-6 Sterilizing Equipment

Set No. 2 – Gas Sterilization 33191100-6 Sterilizing Equipment

2. The subject of the order is to be new, manufactured not earlier than in 2022, admitted to trading on the basis of applicable law and meet all requirements specified by law, in particular the Act of 7 April 2022 on medical devices (Journal of Laws of 2022, item 974) and free from any physical or legal defects.

3. If the trade name of the company, product or product is indicated in the tender documentation, the Ordering Party shall allow equivalent solutions in accordance with the technical data and parameters contained in the documentation. If the Contracting Authority allows solutions equivalent to those described in the documentation attached to the SWZ, but does not provide minimum parameters that would confirm this equivalence – the Contractor is obliged to offer a product with similar properties, functionally suitable for the required application (arg. based on the operative part of the judgment of the National Appeal Chamber of 14 October 2013 [file reference: KIO 2315/13]). The Contractor who refers to solutions equivalent to those described by the Contracting Authority is obliged to demonstrate that the supplies offered by it meet the requirements specified by the Contracting Entity.

NOTE: Its own name is the name under which the item marked by it occurs (or would occur) both in Poland and in other countries.

4. The Contractor undertakes, during the warranty period for the equipment to which the warranty relates and has been included in the technical specification, to provide maintenance, validation and warranty services of the subject of delivery in accordance with the manufacturer's recommendation without incurring costs by the Ordering Party, whereas the minimum warranty conditions must meet the conditions set out in the table of warranty and warranty service conditions constituting Annex 12.1 to 12.2 (appropriate for the offered set) to SWZ.

5. The payment deadline is up to 60 days from the date of receipt of a correctly issued invoice.
