"Collection and management by recovery or disposal of mixed municipal waste and segregated waste from real estate located in the Municipality of Kampinos"

The subject of the contract is the collection and management by recovery or disposal of mixed municipal waste and segregated waste from real estate located in the Municipality of Kampinos, where residents live, as well as from the point of selective collection of municipal waste (hereinafter referred to as PSZOK) located in The town of Kampinos A near the sewage treatment plant and from the point of collection of expired medicines and collection points for used batteries (4 pcs.), in the following ways:

1) ensuring the achievement of the required levels of preparation for re-use and recycling, levels of landfilling of municipal waste and waste from municipal waste processing, levels of reduction of the mass of biodegradable municipal waste transferred to landfill in accordance with the provisions of the Act of 13 September 1996 on maintaining cleanliness and order in municipalities (Journal of Laws of 2022, item 2519, as amended) and currently applicable executive acts to this laws, including in particular:

▪ Regulation of 3 August 2021 of the Minister of Climate and the Environment on the method of calculating the levels of preparation for re-use and recycling of municipal waste (Journal of Laws of 2021, item 1530)

▪ Regulation of the Minister of the Environment of 15 December 2017 on the levels of limiting the storage of the mass of biodegradable municipal waste (Journal of Laws of 2017, item 2412)

2) in accordance with the provisions of the applicable Provincial Waste Management Plan, adopted by the resolution of the Mazowieckie Voivodeship Assembly No. 3/19 of 22 January 2019 on the adoption of the Waste Management Plan for the Mazowieckie Voivodeship 2024, hereinafter referred to as PGO, and in accordance with the Regulations for maintaining cleanliness and order in the Kampinos Commune in force during the term of the contract.

The Contractor, as well as the subcontractor to whom the Contracting Authority has entrusted the implementation of the subject of the contract, pursuant to Article 95(1) of the Act, is obliged to employ, on the basis of an employment contract for the entire period of performance of the subject of the contract, employees performing directly services in the field of the implementation of the subject of the contract (i.e. persons (crews) of garbage trucks, persons performing administrative work related to the service of the contract), because the activities performed by them consist in the performance of work within the meaning of Art. 22 § 1 of the Act of 26 June 1974 — Labor Code (Journal of Laws of 2019, items 1040, 1043 and 1495).
