The services to be awarded relate to the schedule of the following lines:
RE9 federal border DE/PL — Angermünde — Berlin
RB66 federal border DE/PL — Angermünde
Services on the RE9 line include approximately 1,080,000 train km p.a.
Services on line RB66 include approximately 430,000 train km p.a., whereby the commissioning of this service unit is subject to a final clarification by the procurement body with the West Pomeranian voivodeship.
Lines RE9 and RB66 also have to be operated independently between the federal border DE/PL and Szczecin (Szczecin). The procurement body is currently exploring the possibility of involving the West Pomeranian voivodeship.
The negotiations also focus on a possible transformation of the operating program with extension of the RE9 line in the VBB area and an expansion of the scope of services by up to about 200,000 train km p.a.
The services to be awarded include the RE9 Federal Border DE/PL — Angermünde — Berlin line with a total volume of around 1,080,000 train km p.a. and the RB66 federal border DE/PL — Angermünde with a total volume of approximately 430,000 train km p.a. for the period from the timetable change in December 2026 to the timetable change in December 2038. In view of the high demand on the Berlin - Eberswalde section, the RE9 line is considering the use of double-decker vehicles. The services to be operated in-house between the federal border DE/PL and Szczecin (Szczecin) on lines RE9 and RB66 together comprise approximately 230,000 train km p.a..
With regard to the state of Berlin, the award is subject to the availability of the required budget at the planned amount (general budget reservation). The budget reservation is based in particular on the long duration of the procurement procedure, which is contrary to safeguarding the necessary budgetary resources at the time of the invitation to tender. Applicants will receive a separate notification as soon as the general budget reservation has been lifted. If the required budget resources are not available at the planned amount, task holders reserve the right to cancel the procurement procedure in accordance with § 63 paragraph 1 sentence 1 of the VgV. Applicants' costs and expenses related to their participation in the award procedure will not be reimbursed in this case.
The procurement of the public service contract is carried out by means of a competitive procurement procedure according to Art. 5 para. 3 VO (EC) no. 1370/2007 in conjunction with section 131 paragraph 1 sentence 1 GWB in the form of a negotiated procedure with competition in accordance with § 119 paragraph 5 of the GWB, § 17 of the VGV.
Under the conditions specified in the tender documents, the clients assume the risk of reusing vehicles after the expiry of the transport contract (promise of reuse of vehicles).
