1. The subject of the contract is: "Comprehensive sale of high-methane gas fuel with the symbol E to the Ordering Party's facilities in the period 01.01.2023 to 31.12.2023 together with the distribution service, indicated in Chapter I, point 1 – point 4, divided into two parts:
1.1. Part I concerns gas collection points (also called PPG) which will be settled according to the prices of the tariff approved by the President of the Energy Regulatory Office within the meaning of the Act of 26 January 2022 on special solutions for the protection of gaseous fuel customers in connection with the situation on the gas market, the size of the order planned during the contract is: 11 379 660 kWh according to Annex 1a to SWZ,
1.2. Part II concerns PPG settled according to the prices of the competitive market and in part settled according to the tariff price approved by the President of the Energy Regulatory Office, the order size according to the contract planned during the term of the contract is: 3 073 750 kWh according to Annex 1b to the SWZ
2. The total estimated order volume during the delivery period shall be 14453410 kWh
1. The subject of the contract is: "Comprehensive sale of high-methane gas fuel with the symbol E to the Ordering Party's facilities in the period 01.01.2023 to 31.12.2023 together with the distribution service, indicated in Chapter I, point 1 – point 4, divided into two parts:
1.1. 1.2. Part II concerns PPG settled according to the prices of the competitive market and in part settled according to the tariff price approved by the President of the Energy Regulatory Office, the order size according to the contract planned during the term of the contract is: 3 073 750 kWh according to Annex 1b to the SWZ
2. The total estimated order volume during the delivery period is 14 453 410 kWh, to the facilities listed in Appendix No. 1 (Annex No. 1a and Appendix No. 1b) to SWZ.
3. The Contractor shall perform all actions and arrangements with the DSO necessary to change the seller and effectively start the sale of gaseous fuel, including in particular: reporting new comprehensive contracts for the sale of gaseous fuel to the DSO. These activities will be performed by the Contractor on the basis of appropriate powers of attorney granted by each of the Ordering Parties listed in point 1 of the SWZ together with the conclusion of comprehensive contracts for the sale of gaseous fuel.
4. The supplied gaseous fuel must meet technical standards in accordance with the provisions of the Energy Law, implementing acts and Polish Standards.
5. Due to the nature of the deliveries, the expected consumption of gaseous fuel given by the Ordering Party is an estimate and has only an indicative value for comparison, calculation of the value of the offer and does not constitute an obligation to purchase gas in the given quantity. The Contractor shall not be entitled to any claim for the purchase by the Ordering Party (gas recipients) of a smaller or larger amount of natural gas, except for the need to pay for the actual amount of gas and transmission services in accordance with the applicable tariff.
6. In the year of execution of the order, the ordering party reserves the right to reduce or increase the total quantity of purchased gaseous fuel and / or the value of distribution of purchased gaseous fuel: for an increase to 20% for a reduction of up to 20% in relation to the quantity (value) of the order referred to in paragraph 1 (basic orders). The occurrence of the circumstances referred to above will result in an increase or decrease in the remuneration due to the Contractor under the contract, respectively. The change in the amount of gaseous fuel occurs automatically and does not require a statement from the party. Within the scope of this right, the Ordering Party may add and subtract PPG and change the parameters of gas distribution, in which case the Contracting Authority shall submit to the contractor a written declaration of will regarding the exercise of the above right to the extent specified by it. Changes in the tariff group, in accordance with the rules set out by the President of the Energy Regulatory Office, do not require the Ordering Party to submit a declaration of will. If the Ordering Party does not exercise the right to increase or decrease the total quantity of purchased gaseous fuel and/or the value of distribution of purchased gaseous fuel in the scope for an increase of 20% for a reduction of 20% in relation to the volume of the order planned, the Contractor shall not be entitled to any claims in this respect.
