This consultation concerns ex officio brush clearing services of land covered by Article L. 322.3 of the Forest Code and/or subject to the legal obligations of brush clearing the procurement procedure used is: open tender. It is subject to the provisions of articles L. 2124-2, R. 2124-2 1º, R. 2131-18, R. 2132-2, R. 2132-4 to R. 2132-6, R. 2143-1 to R. 2143-2, R. 2151-1 to R. 2151-5, R. 2161-5, R. 2161-4 of the public order code. It is a framework agreement with purchase orders, made at unit and flat prices without minimum or maximum fixing all contractual stipulations and executed as the purchase orders are issued, without negotiation or re-competition, in accordance with the terms laid down in the framework agreement and in application of Articles L. 2125-1 1º, R. 2162-1 to R. 2162-6, R. 2162-13 and R. 2162-14 of the public order code.
The services to be carried out are located on parcels in the territory of the City of Mandelieu-la-Napoule or on adjacent plots, for which the owners of dwellings, constructions or installations of all kinds located in Mandelieu-la-Napoule, have not fulfilled the legal obligations of brush clearing. They may also wear:
— on road shoulders open to public traffic,
— on shoulders of private roads not open to public traffic,
— on track shoulders,
— on land under the power lines of way.
