Assignment of driving performance in regular service

The BVG, as the public procurer (AG), writes out services for buses in the regular service for the calendar year 2019. The subject of the invitation to tender is the provision of services with buses and coaches of the BVG within the scope of the BVG in Berlin / Brandenburg, which the contractor organizes and carries out independently.


A) Line performance 2019, operating hours total (start to end) 13 175 hours, daily 3 round trips = approx. 17 hours

The BVG, as the public procurer (AG), writes out services for buses in the regular service for the calendar year 2019. The subject of the invitation to tender is the provision of services with buses and coaches of the BVG within the scope of the BVG in Berlin / Brandenburg, which the contractor organizes and carries out independently. Temporary employment is not part of the tender. The vehicles required for the provision of services are provided by the BVG. The performance of the proposed lot (s) is scheduled according to the schedule in Part 2 of the Terms of Reference. However, the given values are only guideline values.

The mileage to be awarded is divided into 4 lots with equal hourly volumes, the quantity per lot may deviate by plus or minus 10% per month per month. The individual lots start on 1.4.2019 and end on 7.12.2019. A one-sided option is agreed, according to which the AG can extend the term of single or all lots by a maximum of 6 months.

(1) Subject matter is the provision of scheduled services in local public transport with vehicles of the AG. The provision of individual services calls the AG separately from the contractor, as described in more detail under § 5. These services are provided on behalf of and on behalf of the AG and must be carried out in accordance with the timetable and in compliance with the performance characteristics defined in Part 3 of the Specifications. The AN's obligation to perform also includes the proper sale of tickets and the control of existing tickets as well as the timely settlement of fares.

(2) The contractor must be in possession of a permit for occasional services under § 46 PBefG at all times during the performance of the contract.

(3) Subcontractors may only be used with the prior written consent of the Principal and only on these terms and conditions and in compliance with all other parts of the contract in accordance with § 1. The consent may be denied if there are important reasons by the AG or revoked at any time.

(4) The contractor must proceed with the transfer of parts of the service (subcontract) according to competitive criteria, the subcontractor on request to nominate the AG and give him no more unfavorable conditions - in particular with regard to the method of payment and security payments, as between him and the AG are agreed. In addition, in obtaining subcontracting, the contractor adequately acquires regular small and medium-sized enterprises and endeavors to subcontract those companies to the extent that they may agree with the contractual execution of the service.

(5) The contractor continues to be responsible for the fulfillment of the contract when commissioning subcontractors to the AG. A commission from third parties does not affect the order value or execution deadlines. Subcontractors are vicarious agents of the contractor.

The mileage is usually scheduled so that a break grant according to the FPersV §1 Abs.3 sentence 2 is not possible. Therefore, by the contractor (AN) plannings for the necessary block breaks of the driving staff have to be planned. A block pause grant is not possible. The necessary detachment points and locations are determined by the (AN) independently.

The contractor is obliged to provide his workforce with the performance of the services at least according to the tariffs of the TV-N Berlin in its current version (available at: https://www.dbb.berlin/tarifvertraege/nahverkehrsbetriebe/, when tendered valid version is attached to the tender documents), ie in particular to pay the following fees:

Hourly rate: 12,79 EUR (from 2018) (according to Annex 3 TV-N EC 5 Level 1)

Time supplements: 25% for night work between 21.00 and 6.00

25% on Sundays between 00.00 and 24.00

The performance is to be performed in compliance with all contractual components, in particular the defined quality features according to Part 3 of these specifications and the regulations for the performance of performance according to Part 4 of these specifications.

For drivers of the AN, who were not yet demonstrably active as drivers in the area of the Tarifverbund Berlin Brandenburg and who have not yet completed the current training program of the BVG, the visit to the training program according to Part 5 of these specifications is mandatory at the AG.

The driver of the AN is further obliged to sell tickets. The necessary equipment is provided by the AG. The detailed regulations and descriptions, in particular for the billing of ticket receipts as well as for the operation of the equipment are contained in the contract conditions and in part 4 of these specifications.

The offer must be submitted to the contracting authority named in the publication by means of the enclosed offer form, including all the required equipment and documentation. Offers can be made for one, several or all lots.
