The subject of the contract are services in the field of forest management as defined in Article 6(1)(1) of the Forest Act of 28 September 1991 (consolidated text: Journal of Laws of 2022, item 672 – "Forest Act") covering works in the field of forest breeding and protection, logging and harvesting, to be performed in the area of the Krasiczyn Forest District in 2023. The term of the contract will last from the date of conclusion of the contract until 31.12.2023. The material scope of the contract includes the total quantities of works in the field of forest breeding and protection, logging and skidding resulting from Annex 2 to the SWZ.
The Contractor may submit a bid for one or more Packages. However, the offer submitted for the Package must cover the entire scope of the work provided for in the SWZ for this Package.
Forest management services in Forestry Prałkowce1. The object of the order is forest management services in the Forestry of Prałkowce, covering work in the field of forest farming and preservation, logging and breaking of timber.
2. A detailed description of the subject of the contract is included in Annexes No. 2 to SWZ. The material ranges listed in the annexes are estimates.
3. A detailed description of the standard of technology for performing individual forest works (activities) included in the subject of the contract, which is the basis for determining the quality requirements relating to the elements constituting the subject of the contract, together with a description of the codes of activities describing individual forest works, is included in Annex 3 to the SWZ.
4. In view of the actual natural weather situation that may occur during the execution of the subject of the contract, as well as the economic and economic situation unforeseen at the moment, the Contracting Authority reserves the right to make reductive adjustments, enhancement adjustments, new location, as well as pausing the steps indicated in each line of tables describing the subject of the order. Increasing adjustments do not imply the introduction of new works, not covered by the scope of the contract, and reductive adjustments do not imply a complete abandonment of part They should be understood as increasing the amount of work in one location (forest address) in the Package Implementation Area (including locations in the Package Implementation Area not pre-indicated in the SWZ), while reducing the amount of work in another location (forest address) on Package Implementation Area, within the total quantities of individual work falling within the scope of the Contract Subject as defined in the SWZ, to be carried out throughout the Package Implementation Area. The need to increase the size of certain elements of the procurement in the course of the performance of the contract subject may also occur in order to complete the full range of works described in the subject matter of the contract. Establishing a new location is carried out within the subject of the order, always only in the Package Redeemment Area.
5. The standardization and general principles which, in particular, the Contractor will be obliged to observe in the execution of the subject of the contract are described in paragraphs 3.2 and 3.3 of SWZ.
6. In view of the actual natural situation, the Contracting Authority does not make available any items for machine acquisition (logging using multioperable machinery). The accepted technology of logging in all positions in the forestry industry is the acquisition of a saw.
7. The Contracting Authority shall not reserve the obligation of the Contractor to personally perform key tasks concerning the subject of the contract. The Contractor may entrust the execution of elements (parts) of the object of the contract to subcontractors In the event of an intention to perform the subject of a contract involving subcontractors, the contractor shall indicate in his tender the parts of the contract (tangible ranges) the execution of which he intends to entrust to subcontractors and the names of possible subcontractors if they are already known. This indication should be placed on the Offer. In the absence of an indication in the Subcontract Offer, the Contractor will be able to introduce the subcontractor only under the terms set out in the contract.
8. Pursuant to Article 95 of the Public Procurement Law, the Contracting Authority requires the Contractor or a subcontractor to employ persons performing activities in the scope of contract performance consisting in obtaining and skidding wood raw material, if the performance of these activities consists in performing work in the manner specified in Article 22 § 1 of the Act of 26 June 1974 - Labour Code (consolidated text: Journal of Laws of 2022, item 1510, as amended. died.).
