The subject of this contract is a comprehensive supply of electricity (supply of electricity with distribution service) to the facilities listed in Annex 1 to the ToR - description of the subject of the contract The demand for electricity in the period from 01/01/2020 to 31/12/2021 is: 1 818 492 kWh (change in the amount of energy during the contract +/- 545 548 kWh).
1.1. The subject of this contract is a comprehensive supply of electricity (supply of electricity with distribution service) to the facilities listed in Annex 1 to the ToR - description of the subject of the contract The demand for electricity in the period from 01/01/2020 to 31/12/2021 is: 1 818 492 kWh (change in the amount of energy during the contract +/- 545 548 kWh).
1.2. The detailed scope of the contract is specified in Annex 1 to the ToR, in accordance with the provisions of the Energy Law of 10 April 1997. Other conditions regarding the performance of the contract are set out in the relevant provisions of the contract - in Section 14 of the ToR.
1.3. Comprehensive electricity supply will take place under the conditions set out in the Act of 10 April 1997 - Energy Law and in accordance with the implementing regulations issued to that Act, in particular with the quality standards of customer service specified in the Regulation of the Minister of Energy of March 6, 2019. on detailed rules for shaping and calculating tariffs and settlements in electricity trading and the Ordinance of the Minister of Economy of August 21, 2008 on detailed conditions for the functioning of the power system. The above provisions apply to the method of calculation, billing and quality parameters of the electricity supplied.
1.4. Requirements for the Contractor:
The Awarding Entity shall grant the power of attorney selected in the proceedings to:
1.4.1. Notifications to the relevant Distribution System Operator about the conclusion of the comprehensive electricity contract and the planned date of commencement of the provision of the comprehensive electricity service.
1.4.2. Submission of a statement on the termination of existing comprehensive agreements (sale of electricity and provision of distribution services).
1.4.3. Representing the Employer in contacts with the current Electricity Seller or Distribution System Operator in matters related to the process of changing the Seller applies to the points set out in Annex 1 to the Agreement.
1.5. The comprehensive electricity contracts in force with the current electricity seller for the electricity consumption points included in Annex 1 to the ToR are for a limited period. A detailed description for each of the PPE points can be found in the column "Current contract period / notice period".
1.6. In the course of the contract, the Purchaser reserves the right to reduce or increase the total amount of electricity and the value of distribution of purchased electricity in the range up to ± 30% relative to the amount of energy (distribution value) specified in Annex 1 to the ToR. The occurrence of the circumstances referred to above will result in a reduction or increase in remuneration due to the Contractor under this contract, respectively. Under this law, the Employer may add and subtract energy consumption points. In the case of adding and subtracting energy intake points and changing energy distribution parameters, the Employer shall submit to the Contractor a written declaration of intent regarding the exercise of this right within the scope specified by him. If the Employer does not exercise the right to reduce or increase the total amount of energy and the value of distribution of purchased electricity in the range up to ± 30% relative to the amount of the Contractor, no claims shall be entitled. The total value of the changes described above will not exceed 30% of the value of the comprehensive contract, which will be concluded with the Contractor selected in this procedure.
