Description:
Sherbourne Resource Park Delivery Project

The above named Authorities (the Authorities) intend to jointly develop a new materials recycling facility (MRF) in Coventry capable of processing between approximately 120 000 to 175 000 tonnes of recyclable materials per annum. The Authorities will incorporate a special purpose vehicle (AssetCo) which will own the MRF and enter into the relevant contract(s) to develop the MRF with the preferred bidder(s). Each Authority will be a shareholder of AssetCo. Each Authority will enter into a supply contract with AssetCo to supply recyclable materials to AssetCo for a period anticipated to be at least 20 years.

The Authorities reserve the right to explore the scope for further development of the MRF which may include exploration of the ability to extract low grade plastics at the MRF and to invite other local authorities to participate in the project as a shareholder of AssetCo and to supply additional recyclable materials to the MRF at any time.


Civil Works Package (Lot A)

The Authorities wish to develop a new material recycling facility on a site in Coventry which is capable of processing between approximately 120 000 and up to 175 000 tonnes of recyclable materials per annum (MRF). The site is located on London Road in Coventry and the freehold title of such site is owned by Coventry City Council (the Project). The Authorities intend to submit a planning application imminently for the MRF.

The contracting authority published a prior information notice on 11.2.2019 and held a bidders day on 28.2.2019. The purpose of the bidders day was to outline the contracting authority's proposals and intended Lot structure for the project. The bidders day demonstrated a genuine value and market interest in:

(a) a separately procured civils contract and a separately procured process contract for the MRF with operation and maintenance services being self-delivered by AssetCo (Separately Procured Solution); and

(b) a complete design, build and operate solution which encompasses the civils works package and process works package together with the provision of operation and maintenance services for a period of 5 years (with the option, by mutual agreement, for extension(s) of up to 3 years) (DBO Solution). As each option is capable of delivering the Authorities' objectives for a regional MRF, the procurement process will be used to test and determine the most economically advantageous option for the Authorities.

In order to allow the comparison of a Separately Procured Solution and a DBO Solution, the Authorities have compiled an operational model for AssetCo to operate and maintain the MRF for a period of 5 years post-commissioning. The basis of the operational model is described in the Procurement Pack issued with this contract notice. Bidders should refer to the Procurement Pack for further detail on the proposed Lot structure for this Project including AssetCo's operational model (referred to as 'Lot C'). The basis of AssetCo's operational model/Lot C has been included in the Procurement Pack to provide full transparency to Bidders. Bidders should note that certain aspects of AssetCo's operational model will be determined by the highest scoring Solutions for each of Lot A and Lot B and therefore cannot be provided at this stage of the procurement.

Lot A is for the civil works package for the project which comprises the design and build of the MRF building, and other infrastructure, which is capable of accommodating the process equipment to be procured for the MRF under Lot B and the associated recyclable materials reception, handling and storage requirements. The Authorities envisage the contract for Lot A (civils works package) will be based on an amended model form of NEC 3 engineering and construction contract (Option A).

The first stage of the procurement process comprises a conflated standard selection questionnaire and invitation to submit outline solutions stage. The Authorities do not intend to undertake a separate ISOS stage. All bidders expressing an interest in response to the contract notice will be invited to respond to a SSQ and ISOS questions. The response to the SSQ and response to ISOS questions must be submitted as separate documentation via the Portal. In respect of the Lot A, the responses to the SSQs will be used to create a shortlist of 6 Bidders. The Authorities will only review and evaluate the responses to the ISOS questions of the shortlisted Bidders of Lot A. The responses to the ISOS questions will be used to create a shortlist of 3 bidders to be invited to participate in the next stage of the procurement process for Lot A.


Process Works Package (Lot B)

Lot B is for the process works package for the project which comprises the design, supply, installation, commissioning and testing of the processing equipment for the MRF, which is capable of processing between approximately 120 000 and 175 000 tonnes of recyclable materials per annum. The authorities envisage the contract for Lot B (process works package) will be based on an amended model form IChemE Red Book.

The first stage of the procurement process comprises a conflated standard selection questionnaire and invitation to submit outline solutions stage. The responses to the ISOS questions will be used to create a shortlist of 4 bidders for Lot B to be invited to participate in the ISDS stage.

Lot D is a complete design, build and operate solution for the project which comprises the civils works package and process works package (as described under Lot A and Lot B) together with the provision of operation and maintenance services for the MRF for a period of 5 years post-commissioning (with the option to extend such contract, by mutual agreement of the parties, in multiple extensions of up to a maximum of 3 years). The MRF will need to be capable of processing between approximately 120 000 and 175 000 tonnes of recyclable materials per annum. The Authorities envisage the contract for Lot D (design, build and operate package) will be a bespoke form of contract which is based on a combination of the Lot A and Lot B form of contracts along with provisions relating to the operation and maintenance services to be provided.

Each authority has agreed to supply all recyclable materials collected by or on its behalf within its respective administrative area for processing at the MRF for the duration of the MRF's operation period. The Authorities intend to enter into direct supply agreements with AssetCo for a period of at least 20 years and for the remaining capacity to be marketed to commercial third party waste providers. As at the date of issue of this contract notice, the anticipated tonnage for the first 12 months of MRF operation (2023/24) will be approximately 110 230 tonnes. Bidders should refer to the descriptive document in the procurement pack for further detail on the composition and profile of such recyclable materials.
