The procedure concerns the conclusion of a framework agreement, pursuant to art. 54 of Legislative Decree 50/2016, with a single economic operator, for the performance of engineering services relating to new works and maintenance of road assets owned and managed by the Metropolitan City of Florence global service area road network.

The consideration based on the tender for the framework agreement is € 1,329,556.43, net of legal contributions and VAT, calculated on the basis of an estimated amount of work of € 12,009,678.53, divided into the following categories ID. Works:

- S.04 € 6.412.884,51;

- S.02 € 2.154.331,33;

- V.01 € 2.099.086,60;

- V.02 € 1.343.376,09.

These values are indicative, both as regards the interventions and as regards the division into the categories indicated above. Therefore, the client reserves the right, within the maximum amount (equal to € 1,329,556.43), to request the services covered by the contract for a different amount of the individual categories of the estimated interventions and, if necessary, for secondary categories not mentioned in the list indicated above.

The economic value indicated for the framework agreement does not constitute an indication of contractual consideration, but quantifies a presumed tender requirement for the formal obligations linked to that value. The framework agreement is in fact a contractual instrument for the regulation of the stipulation of any and future "implementing contracts", not predetermined by number, amount and location, which will be entrusted by the contracting authority during the duration of the framework agreement and according to the needs and priorities identified by the Administration. The stipulation of the framework agreement is therefore not a source of immediate obligation between the Metropolitan City and the contractor and is not binding with regard to the assignment to the latter of the "implementing contracts" for a predefined minimum quantity.
