Provision of transport services in domestic road transport of goods, lined transport of postal cargo (service A) on the route RD Wrocław - RD Warszawa - RD Wrocław
1. Provision of transport services in domestic road transport of goods, linear transport of postal cargo (service A) on the route RD Wrocław - RD Warszawa - RD Wrocław.
2. The Contractor undertakes to provide the Ordering Party with Service A, consisting in transporting Shipments, including Shipments, the contents of which will constitute Postal Shipments and the contents of which will constitute dangerous goods within the meaning of Article 2 point 4) of the Act of 19 August 2011 on the transport of hazardous materials, under which the Contractor is obliged to accept Shipments for carriage at the place and time specified in the Schedule for the implementation of Service A, constituting Annex 1 to the Contract, and the issue of Shipments accepted for carriage in the place specified in this Annex.
3. The Contractor undertakes to perform journeys of a total length of kilometers in the basic order – 294 188 kilometers (in words: two hundred ninety-four thousand one hundred and eighty-eight kilometers), whereby the course is considered to be the transport of Shipments from the first place of acceptance of Shipments for carriage specified in the Schedule of Service A, constituting Annex 1 to the contract, to the last place of issue of Shipments specified in this annex.
4. The total length of the trips may be increased on the basis of a unilateral declaration of the Ordering Party (right of option) by no more than – 73 546 kilometers (in words: seventy-three thousand five hundred and forty-six) kilometers.
5. A detailed description of the implementation of service A is described in the "Schedule for the implementation of service A", constituting annexes No. 1 to the model contract.
6. Detailed rules for the implementation of the subject of the contract are specified in the model contract, constituting Annex 3 to the SWZ.
7. All cars intended by the Contractor for the implementation of the subject of the contract should meet the requirements in accordance with Annex 2 to the model contract: Technical and functional parameters of vehicles.
8. Based on its experience, the Ordering Party estimates that for the proper implementation of Service A it is necessary to have at least 1 car.
9. Pursuant to Article 95(1) of the Public Procurement Law, the Contracting Authority shall not require the Contractor, subcontractor or further subcontractor to employ persons performing activities in the scope of the contract performance on the basis of an employment relationship, within the meaning of the Act of 26.06.1974 - Labour Code (Journal of Laws of 2020, item 1320).
