The subject of the order is the delivery of switches. The order was divided into 2 packages (ranges):

Package I - supply of modular switches

Package II - supply of switches with stacking function.

Delivery in each of the packages will take place in accordance with the rules set out in the ToR, including the description of the subject of the order and the contract template for the given package. Option right (only for package I) In addition to the guaranteed order in package I, including the supply of modular switches, the Purchaser reserves the right to fulfill the order covered by the option right. The exercise of the option right will consist in providing elements indicated by the Employer. The description of the elements covered by the option law is provided in the form, description of the subject of the order, package I. Within 7 days from the date of conclusion of the contract, the Employer will provide the Contractor with a single written information on exercising or not exercising the option right.

Supply of modular switches (guaranteed order)

1. Modular access switch - 3 pcs.

2. Line card module - type 1 item 8

3. Line card module - type 2 items 10

4. Line card module - type 3 pcs. 2

5. Insert SFP + 10G, Multimode, 850 nm, LC compatible with the modules described in point 3 pcs. 6

a) performance of the guaranteed order - by December 31, 2018, subject to the provisions of §7 of the model contract;

b) if the Employer exercises the option right, the Employer shall provide the Contractor with one-time information on exercising or not exercising the option right within 7 days from the date of the contract. The Contractor will be obliged to deliver the subject covered by the option law by 21/01/2019. The information will be provided to the Contractor in writing. If the option right is exercised, the Ordering Party shall indicate which of the elements of the option and in what number it specifically orders.

c) Licenses for software embedded in the equipment (licenses for computer software) are granted for an indefinite period.

The contract will be carried out under the conditions set out in the contract template for package I, which is an integral part of the Terms of Reference. The contract template package I provides and sets out the conditions for a possible change in the content of the contract.

»The Contractor should provide in the form a description of the subject of the order, package and manufacturer's name, as well as the model name of the items offered. The form, description of the subject of the order, package I, including the manufacturer's name and model name indicated by the Contractor, constitute the content of the offer. The contractor should submit the following statements, the content of which is on the form, description of the subject of the order, package I: a) We declare and undertake that the equipment offered and supplied by us will be brand new and manufactured not earlier than in the second half of 2017. In the definition of equipment, factory the new equipment does not fit the equipment re-introduced by the manufacturer of the equipment after the refurbished process. The Employer does not allow the delivery of switches re-introduced by the manufacturer after the refurbished process. b) We declare and undertake that the equipment offered and supplied by us will be manufactured in accordance with applicable law and standards, will be fully valuable and usable in accordance with its intended use and will have CE declarations of conformity.

c) We declare and undertake that the equipment offered and supplied by us comes from a legal source, will be covered by a package of warranty rights (under the conditions described in the ToR, including the contract template) included in the price and provided by the equipment manufacturer's service network.

d) We declare and undertake that as part of the warranty, we provide the Employer with access to all corrections and the latest versions of embedded software provided by the manufacturer, including the right to download them directly from the manufacturer's website or otherwise made available by the Contractor, install and use, without violating rights of other persons or entities.

Access switch with stacking function - 4 pcs.

a) performance of the contract - by December 31, 2018, subject to the provisions of §7 of the model contract;

b) Licenses for software embedded in the equipment (licenses for computer software) are granted for an indefinite period.

The contract will be carried out under the conditions set out in the contract template for package II, which is an integral part of the Terms of Reference. The contract template provides for and specifies the terms of any change to the contract content.

»The contractor should provide in the form a description of the subject of the order, package II, name of the manufacturer and model name of the items offered.
