1. The subject of the contract is the provision of care services in the place of residence for the dependents, hereinafter referred to as "Services", referred to in the Act of 12 March 2004 on social assistance, whereby:
1) The order was divided into two parts. Each Contractor may submit a bid for up to one part of the order from among the following:
a) Part 1 – DOPS Region No. 1 – the order covers the provision of Services in the following districts of Gdynia: Redłowo, Orłowo, Karwiny, Dąbrowa, Mały Kack, Wielki Kack, Part of the St. Maximilian Hill, Wiczlino in the amount of a maximum of 90,000 hours during the term of the contract;
b) Part 2 – DOPS Region No. 3 – the order covers the provision of Services in the following districts of Gdynia: Grabówek, Leszczynki, Chylonia, Pustki Cisowskie, Demptowo, Cisowa in the maximum amount of 102,000 hours during the term of the contract.
Part 1 — DOPS Division No 1Services for Lot 1 will be provided in the maximum amount of 90,000 hours during the term of the contract, including the estimated number of hours in 2023 – 50,000 hours, in 2024 – 40,000 hours.
The term number of hours of provision of Services should be understood only as the actual time of providing Services with the indicated mentee. One hour equals one hour, clock hour - 60 minutes. Services will be provided daily from 7:00 to 21:00. The Contracting Authority reserves the right to reduce the expected number of hours of the Services provided, in particular depending on the number of persons applying for the indicated form of aid. The above number of hours of Services is the maximum, while the minimum number of hours of Services provided during the contract completion period is: Part 1 – 65,000 hours.
Detailed information on the subject of the contract and the manner of its implementation is specified in Appendix No. 1 to SWZ - Gdynia standard of care services provided at the place of residence.
Pursuant to Article 95(1) and Article 29(3a) of the PPL, the Contracting Authority requires the Contractor or subcontractor to employ persons performing activities within the scope of the contract of the contract within the meaning of the Act of 26 June 1974 of the Labour Code, i.e. persons performing the service as guardians (not applicable to coordinators), provided that they fall within the scope of Article 22 § 1 of the Labour Code, which reads: 'By entering into an employment relationship, the employee undertakes to perform certain types of work for and under the direction of the employer and at a place and time determined by the employer, and the employer undertakes to employ the employee for remuneration.' The Contracting Authority recognizes that the performance of activities described in § 5 of the Standard consists in performing work in the manner specified in Article 22 § 1 of the Act of 26 June 1974 – Labour Code. Details of this condition are indicated in the SWZ, while the rights of the Contracting Authority in the scope of sanctions for failure to meet the requirements set out in this condition are indicated in the draft contract (Annex 2 to the SWZ).
Description of the subject of the contract specified in the SWZ in this model contract, which constitutes Annex 2 to SWZ. The Contracting Authority does not reserve the obligation of the Contractor to personally perform key parts of the contract. The Contractor may entrust the performance of part of the contract to the Subcontractor. The possibility of applying for a contract is not reserved only by Contractors referred to in Article 94 of the PPL. There is no obligation for the Contractor to undergo an on-site inspection and verification by the Contractor of documents necessary for the performance of the contract available on site at the Contracting Authority. It is not possible to submit a variant bid referred to in Article 92 of the PPL. It does not provide for the conclusion of a framework agreement and the establishment of a dynamic purchasing system, and it does not provide for the selection of the most advantageous bid using an electronic auction. It is not envisaged to award contracts pursuant to Article 214(1)(7) of the PPL. It is not allowed to submit offers in the form of electronic catalogues or to attach electronic catalogues to the offer in the situations specified in Article 93 of the PPL. The settlement of the order is made in PLN. There is no provision for reimbursement of the costs of participation in the procedure, no advance payments for the performance of the contract.
The Contracting Authority allows for the possibility of submitting partial bids, but each of the Contractors may submit a bid for a maximum of one part of the contract.
The term of the contract is 12 months, however, the execution of the contract should start no earlier than from June 1, 2023. Thus, the planned completion date of the basic contract is from 01.06.2023 to 31.05.2024. The option order ends on the completion date of the basic order.
Part 2 — DOPS Division No 3Services for Lot 2 will be provided in the maximum amount of 102,000 hours during the term of the contract, including the estimated number of hours in 2023 – 57,000 hours, and in 2024 – 45,000 hours.
