The proceedings are conducted in accordance with the provisions of the Act of 11 September 2019. Public Procurement Law (Journal of Laws of 2023, item 1605, późn.zm), hereinafter referred to as the Public Procurement Law.

The CONTRACTING AUTHORITY allows for the submission of partial offers, each of which will be assessed by the CONTRACTING AUTHORITY separately, in accordance with the rules described in the Terms of Reference. The order was divided into lots, as described in Appendix 1.1 – 1.3 to the Terms of Reference. Each of the CONTRACTORS may submit an offer for any selected part(s). It is required to submit a bid for all required SKUs within a given part.
Whenever in this SWZ the subject of the contract is described with an indication of the trademarks, patents or origin, source or specific process that characterizes the products supplied by a particular CONTRACTOR, if this could lead to the privilege or elimination of certain contractors or products, it is assumed that such indications are accompanied by the words "or equivalent". The ORDERING PARTY, describing the subject of the contract, on the basis of the instruction expressed in Article 99(4) of the PPL Act, indicated the trademark or origin due to the specificity of the subject of the contract and the inability to describe it in an exhaustive manner using precise and understandable terms. By describing the subject of the contract by means of trademarks, patents or origin, source or special process that characterizes the products supplied, the ORDERING PARTY thus determines the quality, technical and functional parameters that the subject of the contract must meet in order to meet the requirements set by the ORDERING PARTY.
