The subject of the contract includes the performance of a service consisting of peeling, transporting and landscaping of municipal waste from property owners residing in the territory of the Municipality of Brzozie. The Contractor shall be obliged to comply in the course of the execution of the order of the applicable law. The Contractor shall be obliged to use the collected municipal waste in a manner: ensuring that the recycling levels set out in the Act of 13 September 1996 on the maintenance of cleanliness and order in the municipalities (Journal of Laws of 2021, item 888 as amended); ensuring the achievement of the set out in Regulation of the Minister of the Environment of 15 December 2017 under the levels of limitation of mass storage of biodegradable municipal waste (Journal of Laws of 2017, item 2412), the levels of weight restriction of biodegradable municipal waste transferred to storage, which the Municipality of the Municipality is obliged to achieve in individual years. The subject of the contract includes the performance of the service consisting in the receipt, transport and development of municipal waste from the owners of real estate residing in the territory of the Municipality of Brzozie.The Contractor is obliged to comply during the execution of the order of the provisions of the law, in in particular, such as:

(a) the Act of 13 September 1996 on the maintenance of cleanliness and order in municipalities (Journal of Laws of 2021, item 888),

(b) the Waste Act of 14 December 2012 (Journal of Laws of 2021, item 779),

(c) Law of 11 September 2019. Public Procurement Law (Journal of Laws, 2021, item 1129 as amended),

(d) Regulation of the Minister of Climate and Environment of 3 August 2021 on how to calculate levels of preparation for reuse and recycling of municipal waste (Journal of Laws of 2021, item 1530),

(e) Regulation of the Minister of the Environment of 15 December 2017 on levels of limitation of mass storage of biodegradable municipal waste (Journal of Laws of 2017, item 2412),

(f) Regulation of the Minister of the Environment of 1 January 2013 on specific requirements for receiving municipal waste from property owners (Dz, U. 2013 item 122),

(i) Resolution No XXXII/546/17 of the Sejmik of the Kuyavian-Pomeranian Voivodeship of 29 May 2017 on the implementation of the “Waste Management Plan of Kuyavian-Pomeranian Voivodeship 2016-2022 with a perspective for the years 2023-2028”

(j) Regulations of maintenance of cleanliness and order within the Municipality of Brzozie adopted by Resolution No XXI/148/2021 of the Council of the Municipality of Brzozie of 10 March 2021.

(k) Resolution No XXI/149/2021 of the Birch Municipality Council of 10 March 2021 on the detailed manner and scope of the provision of services for the collection of municipal waste from property owners and the development of such waste, in exchange for a fee paid by the owner of the property management of municipal waste

The Contractor shall be obliged to use the collected municipal waste in the manner of:

- ensuring that the recycling levels set out in the Act of 13 September 1996 on the maintenance of cleanliness and order in municipalities (Journal of Laws of 2021, item 888 as amended),

- ensuring the achievement of the Regulation of the Minister of the Environment of 15 December 2017 on levels of limitation of mass storage of biodegradable municipal waste (Journal of Laws of 2017, item 24 12), levels of weight limitation of biodegradable municipal waste transferred to storage, which the municipality is obliged to achieve in individual years.

The Contracting Authority pursuant to Article 95 of the PZP requires employment by the Contractor or Subcontractor on the basis of an employment relationship within the meaning of the Act of 26 June 1974. Labor Code (i.e. OJ 2020 item 1320) of persons performing the performance of the contract, i.e. driving vehicles intended for the export of waste, handling the loading of waste into vehicles.
