1. The subject of the contract is the supply of electricity in the period from 01.01.2024. to 31.12.2024r. to the collection points (PPE) described in detail in Annex 1a and 1b to the SWZ.
2. The indicated forecast electricity consumption is indicative and may differ from the amount of energy actually consumed during the term of the contract. Reducing or increasing the amount of electricity does not entail any consequences for the ordering parties (consumers), except for the need to pay for the amount of energy actually consumed.
3. Applicable billing periods: Tariff group B, C2x – 1 month, Tariff group C1x, G, R – 2 months
4. Distribution services are/will be provided on the basis of separate agreements concluded between the contracting authorities (electricity consumers) and DSOs.
5. The condition for starting deliveries within the contractual period is the effective execution of the change of seller procedure.
Supply of electricity to premises and facilities1. Number of metering systems for consumed electricity 264 pcs.
2. A detailed description of the pre-emptive points (PPE) of the Contracting Party included in Annex No 1a to the SWZ.
3. Estimated electricity consumption during the term of the contract (basic order) – 6 526.64 MWh.
4. The Contracting Authority - the Municipality of Łomża provides for the right of option
5. The contracting authorities indicated below have or will have the status of a Producer in respect of some of the facilities covered by the proceedings. Annex 1a to the SWZ indicates whether the contracting authority has/will have a photovoltaic installation and information on the status of Producer / Prosumer, as well as the estimated amount of electricity generated in the RES installation expected for resale:

4) Novgorod municipality: PL_ZEBB_2007000248_00, PL_ZEBB_2007017109_03.
6. Deliveries will take place from 01.01.2024. until 31.12.2024, subject to the possibility of different start/end dates for deliveries for individual PPEs. Details of delivery times in relation to individual collection points are described in Annex 1a to the SWZ column "Delivery period".
7.Current electricity supply contracts will expire or terminate with effect from the day before the planned start date of supply (column "Delivery period"). The obligation to terminate contracts lies with the contracting authorities (recipients).
8. Quality standards
1) The subject of the order is the supply of electricity with certain quality standards in accordance with applicable regulations.
2) Electricity quality standards are described in the Act of the European Parliament and in the Regulation of the Minister of Economy of 4 May 2007 on the detailed conditions for the operation of the power system (Journal of Laws of 2007 No. 93, item 623, as amended) amended by the Regulation of the Minister of Climate and Environment of 27 September 2022 amending the regulation on detailed conditions for the operation of the power system (Journal of Laws of 2022, item 2007). The principles of shaping and calculating tariffs and settlements in electricity trading are specified in the Regulation of the Minister of Climate and Environment of 29 November 2022 (Journal of Laws of 2022, item 2505, as amended).

10. The Contractor, based on the Power of Attorney granted, will be obliged to submit the contract on its own behalf and the contracting authority to the relevant DSO in accordance with applicable regulations and to represent it before the DSO in the process of changing the seller.
11. The contracting authority reserves the right to use Article 139(1) of the Public Procurement Law, i.e. the possibility of first examining and evaluating tenders, and then making a subjective qualification of the contractor whose offer was the highest rated, in terms of the lack of grounds for exclusion and meeting the conditions for participation in the procedure.
12. As a result of the outcome of the public procurement procedure, 14 contracts will be concluded.
13. The Ordering Party does not require the provision of a performance bond.
14. The Ordering Party shall request a security deposit. In the case of submitting an offer for Part 1 of the order: PLN 100,000.00.
Supply of electricity for the needs of road lighting1. Number of metering systems accounting for consumed electricity 481 pcs.
2. A detailed description of the pre-emptive points (PPE) of the Contracting Party included in Annex No 1b to the SWZ.
3. Estimated electricity consumption during the term of the contract 2 603.64 MWh.

4. Deliveries will take place from 01.01.2024. until 31.12.2024, provided that the details of delivery dates (start and end) for individual collection points are described in Annex 1b to swz column "Delivery period".
5. Current electricity supply contracts will expire or terminate with effect from the day preceding the planned delivery start date (column 'Delivery period'). The obligation to terminate the contracts lies with the contracting authorities (recipients).

10. As a result of the outcome of the public procurement procedure, 10 contracts will be concluded.
11. The Ordering Party does not require the provision of a performance bond.
12. The Ordering Party shall request the lodging of a security deposit. In the case of submitting an offer for Part 2 of the order: PLN 50,000.00.
