The subject of the contract is the provision of a service consisting in the management of unsegregated (mixed municipal waste) and segregated municipal waste from real estate inhabited in the Municipality of Żagań with municipal status and from the Selective Municipal Waste Collection Point in a municipal installation or a waste recovery and disposal installation. The Contractor will carry out the order in accordance with the provisions of law, in particular: a) the Act of 14 December 2012 on waste (i.e. Journal of Laws of 2022, item 699, as amended), b) the Act of 13 September 1996 on maintaining cleanliness and order in municipalities (i.e. Journal of Laws of 2022, item 1297, as amended).

The subject of the contract is the provision of a service consisting in the management of unsegregated (mixed municipal waste) and segregated municipal waste from real estate inhabited in the Municipality of Żagań with municipal status and from the Selective Municipal Waste Collection Point in a municipal installation or a waste recovery and disposal installation. The Contractor will carry out the order in accordance with the provisions of law, in particular: a) the Act of 14 December 2012 on waste (i.e. Journal of Laws of 2022, item 699, as amended), b) the Act of 13 September 1996 on maintaining cleanliness and order in municipalities (i.e. Journal of Laws of 2022, item 1297, as amended). The Contractor is obliged to manage the following fractions of municipal waste with codes: • 20 03 01 - Unsegregated (mixed) municipal waste, • 15 01 01 - Paper and cardboard packaging, • 15 01 01 - Paper and cardboard packaging (contaminated), • 15 01 07 - Glass packaging, • 15 01 07 - Glass packaging (contaminated), • 15 01 02 - Plastic packaging, • 15 01 02 - Plastic packaging (contaminated), • 20 01 10 - Clothing, • 20 01 11 - Textiles • 20 01 40 - Metals, • 20 02 01 - Biodegradable waste, • 20 02 01 - Biodegradable waste (contaminated), • 20 03 07 - Bulky waste, • 16 01 03 - Used tyres, • 17 01 01 - Concrete waste and concrete rubble from demolition and repairs • 17 01 02 - Brick rubble • 17 01 07 - Mixed concrete waste, brick rubble, waste ceramic materials and equipment other than those mentioned in 17 01 06 • 17 09 04 – Mixed waste from construction, repair and dismantling other than those mentioned in 17 09 01, 17 09 02 and 17 09 03. Municipal waste for the purpose of its management will be transferred successively in quantities depending on the amount of waste generated in the city of Żagań and collected by the entity providing the service of collection and transport of municipal waste from the area of the Żagań Commune with urban status. Waste subject to the obligation to be managed in a municipal installation may be managed only in a municipal installation. The Ordering Party requires the Contractor to ensure the implementation of the contract in the scope of management of unsegregated (mixed) municipal waste using a municipal installation for the processing of waste covered by the subject of the contract, indicated in the list referred to in Article 38b(1) of the Waste Act of 14 December 2012 (i.e. Journal of Laws of 2022, item 699, as amended). If the municipal installation run by the Contractor and indicated in the offer will not be able to accept waste during the implementation of this subject of the contract, the Contractor is obliged to indicate another municipal installation that will accept municipal waste at the expense of the Contractor within the same time limit as provided for its delivery to the Contractor. In this situation, if it is necessary to transport municipal waste to another installation at a distance from the Municipality of Żagań with an urban status greater than the distance of the Contractor's installation, the Contractor will cover the difference in costs resulting from the need to transport municipal waste over a longer distance. The Contractor shall notify the entity that will deliver waste to the Contractor for management under this subject of the contract of the fact that it is unable to accept waste, and shall indicate to this entity another municipal installation and the days and times of its receipt of waste at the latest on the first day of the period in which it will not be able to accept waste.
