The subject of the contract is the granting and servicing of a long-term loan in the amount of PLN 8,142,239.00 in order to early repayment of liabilities due after the financial year in order to reduce the total cost of their service.

Deadline for contract performance: from the date of conclusion of the contract (planned month April) in 2023 to 31 December 2030, i.e. 93 months. Repayment of loan installments will take place monthly. 3. The Ordering Party does not provide for the possibility of repayment of loan installments in foreign currencies. All calculations between the contractor and the ordering party will be made in Polish zlotys (PLN). 4. A detailed description of the subject of the contract is included in Annex 1 to the SWZ. 5. The Contracting Authority shall not divide the contract into lots. Thus, the contracting authority does not allow the submission of partial bids referred to in Article 7(15) of the PPL. Reasons for not making the division: The division of the contract would result in the contracting authority not achieving a favorable economic effect in connection with the restructuring of the liabilities incurred. The division of the subject of the contract will cause technical difficulties, additional costs of contract performance and the inability to coordinate the activities of various contractors performing individual parts of the contract, including the launch and repayment of the loan, which could jeopardize the proper performance of the contract. 6. The contracting authority shall not allow variants to be submitted. 7. Pursuant to Article 95 of the PPL, the contracting authority requires that the contractor or subcontractor performing activities related to the performance of the contract employ employees on the basis of an employment relationship, i.e. employ persons performing activities indicated by the Contracting Authority, which consist in performing work in the manner specified in Article 22 §1 of the Act of 26 June 1974. Labour Code (consolidated text: Journal of Laws of 2020, item 1320, as amended). This requirement applies to persons who perform activities directly related to the granting and servicing of the loan during the term of the contract. That obligation therefore does not extend to activities in the exercise of independent managerial functions. Requirements regarding the method of documenting the employment of persons under an employment contract, control rights of the Contracting Authority and sanctions for failure to employ persons under an employment contract have been specified in detail in the draft provisions of the public procurement contract, constituting Annex 1 - Description of the subject of the contract and the draft provisions of the public procurement contract SWZ. 8. The contracting authority does not provide for requirements for the employment of persons referred to in Article 96(2)(2) of the PPL. 9. The contracting authority shall not make the reservation referred to in Article 94 of the PPL 10. The contracting authority does not provide for the award of contracts referred to in Article 214(1)(7) and (8) of the PPL: 11. The Contracting Authority does not provide for the possibility or require the Contractor to carry out an on-site inspection or check by the Contractor of the documents necessary to perform the contract (Article 131(2) of the PPL). 12. The contracting authority does not provide for the return referred to above, except in the case referred to in Article 261 of the PPL. 13. The Contracting Authority shall not make the reservation referred to above both in relation to the Contractor (Article 121 of the PPL) and individual Contractors jointly applying for the award of the contract (Article 60 of the PPL). 14. The Contracting Authority does not provide for the selection of the most advantageous offer using an electronic auction. 16. Pursuant to the provisions of Article 462(1) of the PPL, the Contractor may entrust the performance of part of the contract to a Subcontractor.
