1. The subject of the contract is the replacement of energy-inefficient street lighting in Łomża with lighting characterized by increased energy efficiency, i.e. replacement of electrical luminaires with electric luminaires with LED light sources along with accompanying works at: Legionów Avenue (236 pcs.), Piłsudskiego Street (193 pcs.), Szosa Zambrowska Street (41 pcs), Sikorskiego Street (155 pcs.).

2. The Contracting Party shall not permit submission of partial and variant tenders.

3. Order mode: unlimited tender — pursuant to Article 132 of the Law Pzp.

4. The Contractor is obliged to pay a deposit in the amount of: PLN 20,000.00 (in words: twenty thousand 00/100 zlotys).

1. The subject of the contract is the replacement of street lighting - 625 light points, covering the area of: Legionów Avenue, Piłsudskiego Street, Szosa Zambrowska Street and Sikorskiego Street.

2. A detailed description of the subject of the contract contains Appendices No. 9 to the SWZ (Detailed Description of the Subject of the Contract). The bill of quantities attached to the documentation (Annex 8 to the SWZ) is only an auxiliary element.

3. The project is co-financed by the European Union from the European Regional Development Fund under the Regional Operational Programme of the Podlaskie Voivodeship for 2014-2020 Priority Axis V. Low-emission economy Measure 5.4 Low-emission strategies Sub-measure 5.4.1 Low-emission strategies excluding BOF Project type: Installation/installation of energy-efficient lighting in municipalities or public facilities and lighting control systems (street).

4. The Contracting Authority provides for the application of the so-called reverse procedure referred to in Article 139 (1) of the Pzp Act, i.e. the Contracting Authority shall first examine and evaluate the tenders and then make the qualification of the contractor whose offer has been highest assessed, in the absence of grounds for exclusion and fulfilment of the conditions for participation in the proceedings.

5. The Contractor whose offer will be selected as the most advantageous will be required to provide, prior to the conclusion of the contract, a guarantee of due performance of the contract in the amount of 5% of the total (gross) price stated in the offer.

6. The Contracting Authority shall apply the provisions of Article 5k(1) of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in relation to Russia's actions destabilising the situation in Ukraine (OJ L. L. of 2014 No. 229, p. 1, as amended), taking into account Article 5k(2), (3) and (4) of the aforementioned Regulation.

7. Contractors who are not subject to exclusion pursuant to Article 7(1) of the Act of 13 April 2022 on special solutions for counteracting support for aggression against Ukraine and serving to protect national security (Journal of Laws of 2023, item 129, as amended) may apply for the award of the contract.

8. Pursuant to Article 126(1) of the PPL, before selecting the most advantageous tender, the contracting authority shall call upon the contractor whose bid was rated the highest to submit, within a specified period, not shorter than 10 days, valid as at the date of submission, the following subjective means of evidence in order to confirm the absence of grounds for excluding the contractor from participation in the public procurement procedure:

a) Statements of the contractor, within the scope of Article 108(1)(5) of the PPL, on the lack of belonging to the same capital group, within the meaning of the Act of 16 February 2007 on competition and consumer protection (Journal of Laws of 2021, item 275), with another contractor who submitted a separate bid, or a statement on belonging to the same capital group together with documents or information confirming the preparation of the bid independently of another contractor belonging to the same group Capital.

b) Copy or information from the National Court Register or CEIDG;

c) Contractor's statement on the validity of the information contained in the statement referred to in Article 125(1) of the PPL,

d) Information from the National Court Register,

e) Certificate of the competent head of the tax office,

f) Certificate or other document of the competent local organizational unit of the Social Insurance Institution or the appropriate regional branch or the appropriate local branch of the Agricultural Social Insurance Fund.
