The scope of works includes the renovation of the provincial road No. 809 Przytoczno – Kierzkówka – Krasienin – Lublin on the section from km 28+400 to km 29+550, with a length of 1,150 m, in particular through:

-performance of measurement works at linear earthworks with the preparation of geodetic as-built inventory,

-execution of the trough on the road widenings;

-execution of roadsides reinforcement of crushed aggregates with a thickness of 10 cm after compaction;

- execution of concrete foundation without expansion joints - layer thickness after compaction 30 cm,

-making the foundation of a mineral-bituminous wedge-gravel mixture with asphalt binder - layer thickness after compaction 10 cm,

-mechanical cleaning and sprinkling with cold asphalt emulsion of the foundation or concrete/bituminous surface;

-leveling the existing substructure with a mineral-asphalt mixture with mechanical built-in,

-reinforcement of the ground with geogrids;

-making the surface from mixtures

The scope of works includes the renovation of the provincial road No. 809 Przytoczno – Kierzkówka – Krasienin – Lublin on the section from km 28+400 to km 29+550, with a length of 1,150 m – as in point 28+550. II1.4).1. Pursuant to Article 108(1) of the PPL, the following contractors shall be excluded from the procurement procedure:

1) who is a natural person who has been legally convicted of a crime,

a) participation in an organized criminal group or association aimed at committing a crime or fiscal crime referred to in Article 258 of the Criminal Code,

b) trafficking in human beings referred to in Article 189a of the Criminal Code,

c) referred to in Articles 228-230a, Article 250a of the Penal Code, in Articles 46-48 of the Act of 25 June 2010 on Sport or in Article 54 paragraphs 1-4 of the Act of 12 May 2011 on the reimbursement of medicines, foodstuffs for particular nutritional uses and medical devices (Journal of Laws of 2021, items 523, 1292, 1559 and 2054),

d) financing a terrorist offence referred to in Article 165a of the Criminal Code, or the offence of thwarting or hindering the determination of the criminal origin of money or concealing its origin, referred to in Article 299 of the Criminal Code,

e) of a terrorist nature, referred to in Article 115 § 20 of the Criminal Code, or aimed at committing this crime,

f) entrusting work to a minor foreigner referred to in Article 9, paragraph 2 of the Act of 15 June 2012 on the effects of entrusting work to foreigners staying in the territory of the Republic of Poland contrary to the regulations (i.e. Journal of Laws of 2021, item 1745),

g) against economic turnover referred to in Articles 296-307 of the Criminal Code, an offence of fraud referred to in Article 286 of the Criminal Code, an offence against the credibility of documents referred to in Articles 270-277d of the Criminal Code, or a fiscal offence,

h) referred to in Article 9(1) and (3) or Article 10 of the Act of 15 June 2012 on the consequences of entrusting work to foreigners staying on the territory of the Republic of Poland contrary to the regulations

– or for the relevant criminal act as defined by foreign law;

2. if the incumbent member of his governing or supervisory authority, the partner of the company in a public or partnership or a complementary in a limited partnership or limited partnership or a prosecutor has been legally convicted of the offence referred to in point 1;

3) against which a legitimate judgment of the court or final administrative decision has been given to the payment of taxes, fees or social or health contributions, unless the contractor appropriately prior to the expiry of the deadline for lodging applications for admission to participate in the proceedings or before the deadline for submission of tenders, he has made payments of taxes, fees or social or health contributions due together with interest or fines, or entered into a binding agreement on the repayment of those receivables;

4) against which the prohibition of public procurement was legally ruled;

5) if the contracting authority can conclude, on the basis of credible indications, that the contractor has concluded an agreement with other contractors to distort competition, in particular if belonging to the same capital group within the meaning of the Act of 16 February 2007 on the protection of competition and consumers have submitted separate tenders, partial tenders or applications for admission to the proceedings, unless they show that they have prepared these offers or applications independently of each other;

6) if, in the cases referred to in Article 85 (1), a distortion of competition arising from the previous involvement of that contractor or entity belonging to the same capital group within the meaning of the Competition Protection Act of 16 February 2007 and consumers, unless the distortion of competition caused by this may be eliminated in other ways than by excluding the contractor from participating in the award proceedings.
