Description:

1. The subject of the order is the delivery of an oral vaccine against rabies of free-living foxes to 8 (eight) Provincial Veterinary Inspectorates in the amount of 5 045 808 doses, including 2 471 544 doses in the spring action and 2 574 264 doses in the autumn action.

2. The detailed manner of implementation of the subject of the contract is set out in Annex 1 to the ToR - Description of the subject of the contract and significant provisions of the contract Annex 2 to the ToR.

3. The Employers are the Provincial Veterinary Inspectorates listed in Annex 1 to the ToR (hereinafter collectively referred to as "Units" or "Employers") on behalf of and for which it acts on the basis of a power of attorney: Government Administration Service Center ul. Powsińska 69/71, 02-903 Warsaw.

4. As a result of these proceedings, contracts will be concluded between the Contractor and each Unit listed in Annex 1 to the ToR.

5. The Awarding Entity does not anticipate orders referred to in art. 67 section 1 point 7.

3. As a result of these proceedings, contracts will be concluded between the Contractor and each Unit listed in Annex 1 to the ToR constituting the List of provinces and relevant Provincial Veterinary Inspectorates and the number of vaccine doses.

4. The Awarding Entity provides for the option right. The subject of the order in the amount specified in point 1 is the basic scope related to the purchase of vaccines. If it is necessary to carry out an additional fox vaccination campaign, the Entity exercising the option right may purchase up to 50% more vaccines in relation to the basic contract included in the contract concluded with the contractor (in the case of the Warmian-Masurian Voivodeship, the Entity may purchase up to 100% more vaccines) . Each Unit (excluding the Warmian-Masurian Voivodeship) may purchase up to 50% less vaccines in relation to the basic order contained in the contract concluded with the contractor, in the event of the quantitative demand for the vaccine by the Unit being reduced, in particular when spring, the public procurement procedure for vaccine delivery or vaccine discharge service will not be completed.

5. The exercise of option rights is not mandatory for Units. If the Units do not exercise the option, the Contractor shall not be entitled to any claims in this respect.

6. The unit price of vaccines ordered under the option right may not be different from the unit price of vaccines specified in the offer submitted by the Contractor under the said procedure. On the basis of art. 25 paragraph 1 point 2 of the Public Procurement Law, the Contractor, together with the offer confirming that the offered vaccine meets the requirements specified by the Employer, referred to in Annex 1 to the ToR, submits together with the offer the Specification of the veterinary medicinal product of the offered vaccine. The above-mentioned document is of a subject-related nature and will be supplemented in the manner specified in art. 26 section 3 of the Public Procurement Law (this document does not constitute the content of the offer).

7. The option right will be exercised through written orders addressed by the Unit to the Contractor. Orders will specify, among others the amount of vaccine ordered, date and address of delivery and contract number on the basis of which the option right is exercised.
