The subject of the contract is the development of design documentation (without the Technical Design) and obtaining on its basis a building permit for the investment task entitled: "Construction of a heat pump unit using waste heat of municipal wastewater of the Central Sewage Treatment Plant

in Gliwice"

The detailed scope of the contract and the conditions for implementation are specified in the SWZ, the description of the subject of the contract and in the draft provisions of the public procurement contract.

1. The subject of the contract for the implementation of the task - the investment entitled: ""Development of design documentation (without the Technical Design and obtaining on its basis a building permit for the investment task entitled: "Construction of a heat pump unit using waste heat of municipal wastewater of the Central Sewage Treatment Plant in Gliwice"

2. is:

a) preparation of the project information sheet (KIP) of the project documentation together with all necessary and required tests, arrangements, decisions and permits provided for by law, such as: construction project including land development project (PZT), architectural and construction design (PAB) and all other documents necessary to obtain a building permit (without technical design) and obtaining on this basis the final decision for a building permit, as well as

b) preparation of a draft investment implementation schedule together with the estimated total investment outlay and outlays at individual stages of investment implementation, and

c) preparation of a functional and utility program in accordance with the Public Procurement Law (i.e. Journal of Laws of 2022, item 1710) in order to conduct a tender procedure for the design and execution of construction works on the basis of the design documentation referred to in point 1 letter a,

d) provision in the form of: (i) implementation of changes and modifications: design documentation or development of a functional and utility program, (ii) preparation of answers to contractors' questions, (iii) responding to statements and comments made by potential or actual contractors, (iv) responding to comments or claims of contractors regarding defects in design documentation together with submitting their position to the Contracting Authority

with justification, and:

e) transfer to the Ordering Party of proprietary copyrights to design documentation and development of a functional and utility program and transfer of proprietary copyrights to changes and modifications of these works and transfer to the Ordering Party of derivative rights to all works made by the Contractor as part of the implementation of the subject of the contract in the field of exploitation described in the model contract constituting Annex 8 to the SWZ.

2. The design documentation and the functional and utility program covered by the contract are to include the task "Installation of a heat pump unit using waste heat of municipal wastewater of the Central Sewage Treatment Plant in Gliwice"

3. The scope of work shall include all work and activities necessary for the performance of the task, including the following elements:

• development of a construction project including a Land Development Project and an Architectural and Construction Design (without a Technical Design) with the required arrangements, decisions and permits along with obtaining the final decision of the building permit. The development of design documentation must take place taking into account the location of the project provided for in the study of PROEN Sp. z o.o., i.e. on plots No. 162 and 112/2 leased from PWiK Sp. z o.o. Port precinct - the area of the Central Sewage Treatment Plant (SOMETHING) in Gliwice, 16 Edisona Street.

• preparation of requests for opinions, arrangements, permits, decisions,

obtaining opinions, arrangements, permits, decisions and derogations (if it is necessary to obtain derogations),

• preparation of non-mentioned design studies, and related to the requirements of opinion-giving units, but not exceeding the subject of the contract,

• preparation of a draft schedule for the implementation of the investment along with the development of a list of capital expenditures with a breakdown into individual stages of investment implementation,

• development of a functional and utility program in accordance with the Public Procurement Law (i.e. Journal of Laws of 2022, item 1710), in order to conduct a tender procedure for the design and execution of budo works
