Processing of applications for state guarantees, the administration of state guarantees including default processing and recourse management after the country has been used
Business administration for the state of Brandenburg within the meaning of Number VII.1 of the Guarantee Guideline of the State of Brandenburg for the commercial guarantee and the liberal professions (http://www.mdf.brandenburg.de/cms/detail.php/bb2.c.432584. de).
The guarantee procedure is based on the aforementioned provision. State guarantees are assumed as deficiency guarantees. The guarantee obligation amounts to a maximum of 80% of the credit risk. The total amount of a national guarantee is limited to a commitment of EUR 10 000 000. Guarantees with a maximum guarantee liability of EUR 1 000 000 are mainly covered by the guarantee program of Bürgschaftsbank Brandenburg GmbH. The current agency agreement expires at the end of next year. It is intended to reassign the contractual relationship.
The business owner has to provide the following services:
a) Processing of the guarantee applications: preliminary negotiations with investors and lenders, application acceptance, examination of the application in terms of legal and economic acceptability of the assumption of guarantee in accordance with European, national and regional legislation including the applicable budgetary law; Preparing the meetings of the National Guarantee Committee, holding the meetings and the decisions of the Committee; Processing the issuing of the guarantees;
(b) management of national guarantees: continuous monitoring of lenders and borrowers with regard to compliance with conditions and conditions of guarantee, monitoring of the economic development of the guarantors, consideration of amendments;
(c) verification of guarantee failures based on the lenders 'claims reports, settlement of claims on behalf of the country, management of lenders' claims transferred to the country following the payment of damages;
(d) assist the country in developing the guarantee program and in carrying out reporting obligations to third parties (EU, federal, regional authorities, parliament).
