1. The subject of the contract is the supply of electricity to facilities in the municipalities of Brzeźnica, Osiek, Polanka Wielka, Przeciszów, Spytkowice, Tomice and Zator, with a total estimated volume of 14,373,590 during the supply period, i.e. from 01.01.2024 to 31.12.2025 separately for each metering system, but not earlier than after the effective termination of the existing energy supply agreements and a positive procedure for changing the supplier.
2. A detailed description of the subject matter of the contract, including the list of facilities referred to in paragraph 1 and the planned electricity consumption shall be included in Appendices No. 9, 10, 11 and 13 to the Terms of Reference.

3. The sale of electricity will take place under the conditions specified in the provisions of the Act of 10 April 1997. Energy Law (consolidated text: Journal of Laws of 2022, item 1385, as amended) and in accordance with the implementing regulations issued to this Act, in particular with the standards of customer service specified in the Regulation of the Minister of Climate and Environment of 22 March 2023 on the detailed conditions for the operation of the power system (Journal of Laws of 2023, item 819). The standards for the performance of the contract are set out in these legal acts.
4. The Contractor who wins the tender undertakes to submit, on behalf of the Contracting Authority, to the Distribution System Operator competent for the Contracting Authority, a notification on the conclusion of a contract for the sale of electricity to individual facilities.
5. The Contracting Authorities reserve the right to withdraw from the sales agreement for facilities in which it will be necessary to conclude a comprehensive agreement due to the implementation of RES installations.
6. The Contracting Authority requires that, in accordance with Resolution No. XXV/373/20 of the Małopolska Regional Assembly of 28 September 2020 on the Air Quality Plan for the Małopolska Region, electricity supplied to public buildings comes from renewable sources.
