The city of Göttingen is seeking to conclude a framework agreement on the use of a service bike leasing. A contractual partner is sought for this. Appropriate hiring and use contracts are to be concluded with the employees. The basis for drafting the contract is the “collective agreement for the conversion of remuneration for the purpose of leasing bicycles in the municipal public service” (TV bicycle leasing). The offer is intended to be available to all approximately 2,000 collective wage employees in the city, incl. Own operation apply.

As the employees come from the entire region around Göttingen, emphasis is placed on a large network of bicycle dealers in Göttingen and the surrounding area, as well as comprehensive services.

There is no acceptance obligation on the part of the client. The estimated annual demands/utilisation cannot be specified in more detail, as no experience is yet available for the present service.

As part of a so-called service bike leasing model, the client would like to hand over bicycles with or without motor support to interested tariff employees by means of a gross salary conversion.

There are currently around 2,000 employees working for the client; it is currently assumed that a maximum of 5 percent of the beneficiaries are allowed to make use of the offer.

The contractor assumes leasing and insurance of bicycles, services (maintenance/repair) as well as the handling of the order, return and claims handling processes for the client (if necessary within the framework of a bidding group or with subcontractors) and is to coordinate the aforementioned relationships and services and manage and ensure continuous service provision. For this purpose, framework agreements are concluded for the services to be provided, for which no costs arise for the contractor.

In addition, on the basis of the specifications of the service description/other contract documents, the contractor concludes a leasing framework agreement and, if necessary, a framework insurance and a maintenance framework agreement with the contractor or another company designated by the contractor. The client concludes an individual leasing contract with the contractor for each bicycle ordered by an employee. For each individual leasing contract, the client concludes a temporary contract (according to the client's specifications) with the respective employee, which regulates their rights and obligations with regard to the bicycle and in particular the salary conversion.

The framework agreement is concluded for a period of 36 months with the client's unilateral extension option of 12 months.

The individual leasing contracts based on the agreement also have a fixed term of 36 months. The term of the individual leasing contracts can therefore outlast the term of the framework agreement. All services included in the framework agreement must be made available until the end of the last individual leasing contract. The support provided by the contractor therefore ends with the expiry of the last individual leasing contract.

The value of the bicycle must not exceed 7,000 euros gross (including leasable accessories). The manufacturer's recommended retail price is decisive.

To ensure its attractiveness, the contractor must offer an extensive range of bicycles at least two branches in the Göttingen city area and at least six branches in the surrounding area (approx. 50 km radius of Göttingen) as well as at least one online specialist retailer. Proof of the entire dealer network must be substantiated by submission of tenders.

The warranty conditions and warranty conditions linked to the make apply to leased objects without restriction.

The contractor must provide a list of authorized repair shops of the bicycle suppliers for necessary repairs.

The contractor's scope of services includes a maintenance package for each individual leasing contract.

Premature termination of the transfer of use by the employee and return of the bicycle during the predefined period of use is generally not possible and is only permissible in justified exceptional cases.

A holistic online portal is provided by the contractor for handling the entire service bike leasing process. Among other things, this must enable a completely digital ordering process.

The contractor makes an offer to the employees to take over the leased bicycle after the individual leasing contract has expired without any further involvement of the client.
