3.1. The subject of the contract is the collection and management of waste from the area of the Wojnicz Commune divided into 2 parts:
3.1.1. Part 1 - Collection and management of municipal waste from property owners residing in the Wojnicz Commune.
3.1.1.1. A detailed description of the subject of the contract for part I can be found in Annex 1.1. to the SWZ – Description of the subject of the contract
3.1.2. Part 2 – Collection and management of solid waste from municipal facilities, municipal cemetery and from cleaning of markets, streets and squares as well as organizational units in the Wojnicz Commune, divided into two scopes:
3.1.2.1. Scope I: Collection of solid waste from municipal facilities, municipal cemetery from cleaning of markets, streets and squares;
3.1.2.2. Scope II: Reception of solid waste from organisational units.

Collection and management of municipal waste from owners of real estate residing in the Wojnicz Commune3.1.1. Part 1 - Collection and management of municipal waste from property owners residing in the Wojnicz Commune.
3.1.1.1. A detailed description of the subject of the contract for part I can be found in Annex 1.1. to the SWZ – Description of the subject of the contract.
3.1.1.2. The quantities of waste specified in the offer form, broken down by waste fraction, are maximum quantities. The Ordering Party reserves the right to reduce the scope of the order, which is tantamount to incomplete use of the quantities resulting from the offer form. The actual quantities of waste to be collected may differ from those stated and will depend on the actual demand of the Ordering Party. However, the minimum scope of the contract to be carried out by the contractor will not be less than 70% of the amount of individual waste fractions indicated in the offer form.
3.2. Order with option right - part 1:
3.2.1 The scope of the basic order is the amount of waste broken down into individual waste fractions in Mg/year specified in the offer form. The contracting authority provides for the possibility of exercising the right of option in the scope of up to a maximum 30% increase in the collection and management of the amount of waste broken down into individual fractions specified in the offer form.
3.2.2 The right to exercise the right of option will be related to the current needs of the Ordering Party regarding the need to collect and manage more waste than the amount of waste provided for in the offer form, resulting from the amount of waste generated by residents.
3.2.3 In order to activate the option, the Contracting Authority shall provide the Contractor, in writing, with a statement in which it expresses its will to exercise the option right and specifies to what extent it exercises the option right. The statement will be submitted no later than 14 days before the date of performance of the service covered by the option right. If the option right is exercised, the Contracting Authority shall provide the Contractor with the statement referred to in the first sentence no later than 30 days before the end of the performance of the contract covering the basic scope of the contract.
3.2.4 In the scope of an optional order, the Contractor is obliged to start providing the service on the basis of a written statement of the Contracting Authority on the exercise of the option right.
3.2.5 The exercise of the option right by the Purchaser may be made once for the entire value of the optional order or in several parts. In the case of exercise of options in several parts, the Contracting Authority shall submit further statements to the Contractor no later than before the maximum scope resulting from the option right is exhausted.
3.2.6 The Ordering Party reserves that the order covered by the option right will be executed on the terms of the basic contract, in accordance with the provisions of this contract, SWZ and the Contractor's offer.
3.2.7 If the Ordering Party exercises the option right, the Contractor is entitled to remuneration for the actual quantities of municipal waste collected and managed. The Contractor's remuneration for the performance of the service covered by the option right shall be calculated on the terms provided for in this contract and on the basis of unit prices indicated by the Contractor in the offer, the list of which is included in Annex 1 to the contract.
3.2.8 The right of option is a unilateral right of the Ordering Party, which may but is not obliged to use as part of the performance of the subject of the contract. If the Ordering Party does not exercise the option right, the Contractor shall not be entitled to any claims in this respect.
3.2.9 The exercise of the option right by the Ordering Party does not require the preparation of an annex to the contract.

- Scope I - The quantities of containers/containers/bags specified in the offer form for collection and disposal during the term of the contract are maximum quantities. The Ordering Party reserves the right to reduce the scope of the order, which is tantamount to incomplete use of the quantities resulting from the offer form. The actual quantities of waste to be collected may differ from those stated and will depend on the actual demand of the Ordering Party. However, the minimum scope of the contract executed by the contractor will not be less than 70% of the number of containers/containers/bags to be collected and managed during the term of the contract.
- Scope II - The quantities of containers / containers / bags specified in the offer form for collection and disposal during the term of the contract are basic / guaranteed quantities.
