1. The subject of the contract is the execution of works in the field of care and removal of trees and plantings of trees and shrubs in the areas of squares and green areas in the Targówek District of the Capital City of Warsaw, as part of the project from the participatory budget called "More greenery for Targówek".
Order description:
1) preparing the area for planting trees and shrubs;
2) planting trees and shrubs with "bare root", or in containers;
3) mulching with bark of flowerbeds, bowls by trees;
4) dressing of planted trees;
5) marking planted trees and clusters of shrubs with the logo from the participatory budget;
6) care of planted trees and shrubs;
7) removal of trees along with carp milling;
8) tree care;
9) export of branches, branches, tree trunks.
1. 2. The Contracting Authority requires employment on the basis of an employment relationship, in the manner specified in Article 22 § 1 of the Act of 26 June 1974 – Labour Code (Journal of Laws of 2022, item 1510, as amended), referred to in Article 95 paragraph 1 of the Act, by the Contractor or subcontractor, persons performing the activities indicated in Annex 2 to the SWZ.
All issues related to the method of verification of employment referred to above, as well as the rights of the Contracting Authority in the scope of control of the Contractor's compliance with the above-mentioned requirements and sanctions for failure to meet these requirements, are specified in the draft provisions of the contract constituting Annex 1 to the SWZ.
3. The contracting authority shall not allow partial bids to be submitted. Justification: The procedure in question forms part of a contract for services in the field of planting plants and maintenance of green areas - individual parts of the contract are the subject of a separate procedure and will be awarded in separate proceedings.
4. The Contracting Authority shall not reserve the obligation for the Contractor to personally perform key tasks of the subject of the contract.
5. The Contracting Authority does not envisage awarding the existing Contractor services with the contract referred to in Article 214(1)(7) of the Act, consisting in the repetition of similar services.
6. The Contracting Authority shall not require the submission of such means of proof.
7. The Contracting Authority shall not permit the submission of variant tenders.
8. The Contractor shall become the producer of waste resulting from the performance of the subject of the contract. The method of waste management must comply with the provisions in force on the date of contract performance, i.e. the Act of 14 December 2012 on waste (Journal of Laws of 2022, item 699, as amended) and the Act of 13 September 1996 on maintaining cleanliness and order in municipalities (Journal of Laws of 2022, item 2519).
