The subject of the contract is the purchase of electricity for the Ordering Party's facilities located in the following communes: Wodzisław Śl., Radlin, Rydułtowy, Gorzyce, Marklowice.

1) The subject of the contract is the purchase of electricity for the facilities of the Contracting Authority located in the municipalities: Wodzisław Śl., Radlin, Rydułtowy, Gorzyce, Marklowice in the period from 01.01.2024. by 31.12.2025" in an estimated amount of 6272.074 MWh.

2) The estimated demand for electricity is specified in Annex 5 to the SWZ. The quantities presented in Annex 5 to the SWZ are estimated quantities, calculated on the basis of historical collection to date, in order to determine the value of the contract. The Contracting Authority stipulates that the minimum total amount of estimated energy consumption will not be less than 60%.

3) The sale of energy will take place via a distribution network belonging to the local Distribution System Operator (DSO). The Ordering Party requires that the Contractor performing the order at the latest on the day of conclusion of the sales contract has concluded a binding contract with the DSO, on the basis of which it is possible to sell electricity through the distribution network of this DSO to all the Ordering Party's facilities indicated in Annex 5 to the SWZ.

4) Settlements for the supplied electricity will be based on indications of metering and settlement systems according to unit prices for a given point of consumption on the basis of actual energy consumption and will be increased by the value of a fixed component payable monthly, specified in the Contractor's price offer (commercial fee).
