The subject of the contract is: "Supply of hot water stabilizers and diaphragm vessels for the needs of heat substations" divided into two parts.
Part 1: Supply of hot water stabilizers
Part 2: Supply of diaphragm vessels
Supply of hot water stabilizers1. The subject of the contract is: Supply of heat storage tanks
2. The details of the subject of the contract and its scope shall specify:
2.1. Appendix No. 1 to the Terms of Reference ("Offer" Form – Part 1).
2.2. Appendix No. 4 to the Terms of Use ("Technical requirements for hot water stabilizers").
3. The devices being the subject of the order must be brand new, unused, i.e. manufactured not earlier than 6 months before the date of their delivery to the Ordering Party.
4. The equipment which is the subject of the contract must meet the requirements of:
- the Act of 16 April 2004 on construction products (consolidated text, Journal of Laws of 2021, item 1213) together with the implementing provisions to this Act,
- The Act of 30 August 2002 on the Conformity Assessment System (i.e. Journal of Laws of 2023, item 215),
- Regulation (EU) No 305/2011 of the European Parliament and of the Council of 9 March 2011 laying down harmonised conditions for the marketing of construction products and repealing Council Directive 89/106/EEC.
- Regulation of the Minister of Development of 11 July 2016 on the requirements for pressure equipment and pressure equipment assemblies (Journal of Laws of 2016, item 1036) implementing Directive 2014/68/EU into Polish law (applies to Part 2) and must meet the EU environmental standards specified in the announcements of the President of the Polish Committee for Standardization on the list of harmonized standards.
5. The equipment which is the subject of the contract must have:
- A Declaration of Conformity or a copy of the Declaration of Performance in accordance with applicable standards and regulations in this regard (applies to Part 1).
- National Declaration of Performance for the supplied thermal insulation (applies to Part 1),
- Hygienic certificate of the National Institute of Hygiene (applies to Part 1).
6. The required minimum period of quality guarantee for the completed subject of the order: 60 months (applies to Lot 1) from the date of their protocol acceptance.
Warranty in accordance with the conditions set out in Chapters XVI and XIX of the SWZ.
7. Other terms and conditions of the Contracting Authority concerning the subject matter of the contract are set out in Chapter XIX of this Terms of Reference entitled "PROVISIONS OF THE PUBLIC PROCUREMENT AGREEMENT RELEVANT TO THE PARTIES".
Shipping of diaphragmatic vessels1. The subject of the order is: Delivery of diaphragm vessels.
2. The details of the subject of the contract and its scope shall specify:
2.1. Appendix No. 2 to the Terms of Reference ("Offer" Form – Part 2).
2.2. Appendix No. 5 to the Terms of Use ("Technical requirements for diaphragmatic vessels").
3. The devices being the subject of the order must be brand new, unused, i.e. manufactured not earlier than 6 months before the date of their delivery to the Ordering Party.
4. The equipment which is the subject of the contract must meet the requirements of:

- Current EC certificate of conformity (Declaration of Conformity) in accordance with Directive 2014/68/EU on the essential requirements for pressure equipment and pressure plants (applies to Part 2)
6. The required minimum period of quality guarantee for the completed subject of the order: 24 months (applies to Lot 2) from the date of their protocol acceptance.
Warranty in accordance with the conditions set out in Chapters XVI and XIX of the SWZ.
9. Other terms and conditions of the Contracting Authority concerning the subject matter of the contract are specified in Chapter XIX of this Terms of Reference entitled "PROVISIONS OF THE PUBLIC PROCUREMENT AGREEMENT RELEVANT TO THE PARTIES".
