1. The subject of the contract is winter road maintenance in the city of Biała Podlaska in the 2023-2024 season, carried out in accordance with the Ordinance No. 120/13 of 27.08.2013 of the Mayor of the City on the introduction of winter road maintenance guidelines (ZUD). 2. List of roads and summary of areas:

1) the national road with connectors is attached as Annex 1 to the SWZ;

2) access (service) roads to the national road, cleared of snow only at the request of the Ordering Party, constitutes Annex 2 to the SWZ;

3) streets covered by the first order of winter maintenance, constitutes Annex 3 to the SWZ;

4) streets covered by the second order of winter maintenance, constitutes Annex 4 to the SWZ;

5) streets covered by snow removal and sand sprinkling, constitutes Annex 5 to the SWZ;

6) dirt roads, cleared of snow only at the request of the Ordering Party, constitute Annex 6 to the SWZ;

1. Minimum standards of road maintenance in the city:

1) roads covered by the first order of winter maintenance:

a) national road – standard 2 increased;

b) provincial roads – standard 2 ordinary;

c) county roads – standard 3;

d) municipal roads – standard 3;

2) roads covered by the second order of winter maintenance – standard 4;

3) roads provided for sand sprinkling – standard 4;

4) access roads (service) of the national road – standard 4;

5) dirt roads – standard 6;

subject to Chapter IV. paragraph 7 point 1.

2. The Ordering Party reserves the right to change the list of roads assigned to a particular order of winter maintenance. Changing the list of roads does not require an annex to the contract. The Contractor will be notified of the change in writing. The amended list of roads within the scope of the change shall replace its existing provisions as of a specified date.

3. Scope of the Contractor's duties:

1) snow removal of street roadways:

(a) ensuring the passability of the streets listed in Annex 1, 3, 4 and 5 (2 ÷ 4 standard of winter road maintenance);

(b) in the event of heavy snowfall, the permissible time of street impassability shall not exceed 4 hours for the streets listed in Annex No 1, access roads (service), national road Nos 4 and 5 (4 standard of winter road maintenance);

c) in the event of particularly difficult weather conditions, street impassable times are allowed, in accordance with the standards of winter road maintenance in Biała Podlaska;

(d) removal of slipperiness on an ongoing basis by spraying with saline solution using a solar panel of the streets specified in Annexes 1, 3 and 4 or, if necessary, sprinkling with a sand-salt mixture;

2. combating the slipperiness of the streets listed in Annex No 5 by sprinkling sand;

3) in case of heavy snowfall:

(a) the export of snow from places indicated by the Contracting Authority;

(b) snow removal of dirt roads indicated by the Contracting Authority;

(c) snow removal of access roads (service) indicated by the Contracting Authority;

4) conducting the necessary round-the-clock duty and surveys of the pavement states stating the legitimacy of the use of the equipment;

5) The Contracting Authority reserves the possibility of dispensing with part of the services by the Contractor in case of carrying out any works in the road lane.

6) Standards of winter maintenance of roads administered by the President of the City Biała Podlaska are determined by the Order No 120/13 of the President of the City Biała Podlaska of 27 August 2013 on the introduction of the “Guidelines for Winter Maintenance of Roads”, annex 7 to the SWZ.

4. The Contractor is obliged to secure its offer with a deposit in the amount of: PLN 50,000.00. (in words: fifty thousand 00/100 zlotys);

5. The contractor whose tender is considered to be the most advantageous will not be obliged to lodge a security for the proper performance of the contract.
