The subject of the procedure and the contract is the selection of the Contractor in the scope of providing successive services regarding the implementation of the task entitled: "Maintenance of high greenery in the Municipality of Krakow in the years: 2022 - 2025", divided into tasks respectively in relation to one to seven parts of the contract, for the Municipal Greenery Board in Krakow. Procedure No NP.26.2.20.22.BT.

The contract in the basic scope includes the successive implementation of services, activities and works as part of the task entitled: "Maintenance of high greenery in the Municipality of Krakow in the years: 2022-2024 divided into tasks", in relation to one to seven parts of the contract, covering in particular the scope described in the description of the Subject of the Contract (OPZ) below, divided into parts corresponding to the appropriately specified areas from 1 to 7.

Part 1 of the contract - includes the successive implementation of services, activities and works as part of the maintenance of high greenery in the Municipality of Krakow in the years: 2022 - 2024, in particular the scope described in the OPZ with attachments and the scope of works with a cost estimate within the parks located in the area of Śródmieście covering districts I, II, III and Podgórze covering districts VIII, IX, X, XI, XII, XIII and Vistula Boulevards in their entirety.

1.4. The Ordering Party reserves the right to exercise the right of option, in whole or in part, specified, inter alia, in Article 441 of the PPL Act, i.e. to increase the scope of the subject of the contract. Part of the subject of the contract described in the SWZ and the option agreement concerns the possibility of ordering the performance of further services for the maintenance of high greenery. Therefore, the Ordering Party may or may not commission the Contractor to perform the contract covered by the option right in whole or in part. The Contractor shall not be entitled to any claims due to the Ordering Party's failure to exercise the right of option, in whole or in part. The Ordering Party guarantees the implementation of the basic order. The Contractor is entitled to remuneration for the actually completed scope of the subject of the contract. The right of option applies to the instruction within the subject of the contract to perform by the Contractor further services in the field of maintaining high greenery in whole or in part. The Contracting Authority makes the exercise of the right of option dependent on the financial possibilities allowing for their exercise. In order to exercise the right of option, in whole or in part, the Ordering Party shall provide the Contractor with a statement in writing or electronically with a qualified electronic signature to the address of the registered office or e-mail indicated for correspondence by 31.12.2024, and in such a case the Contractor will be obliged to implement it in accordance with the requirements of the SWZ and its annexes and for the price and within the deadlines resulting from the content of the submitted offer and the concluded contract.

Part 2 of the contract - includes the successive implementation of services, activities and works as part of the maintenance of high greenery in the Municipality of Krakow in the years: 2022 - 2024, in particular the scope described in the OPZ with annexes and in the scope of works with a cost estimate within the parks located in the area of Krowodrza covering districts IV, V, VI, VII and Nowa Huta covering districts XIV, XV, XVI, XVII, XVIII
