Convert Oracle Database Standard Edition Software License to Oracle Database Enterpirise Edition

Convert Oracle Database Standard Edition software licenses to Oracle Database Enterpirise Edition. A detailed description of the subject of the contract, shall include a model contract, as set out in Annex 7 to the SWZ.

1.The object of the order is the conversion of the Oracle Database Standard Edition software license to Oracle Database Enterpirise Edition.

2. Licenses must come from the manufacturer's authorized sales channel. A detailed description of the subject of the contract shall include the model of the contract, as set out in Annex 7 to the SWZ

3. The Contracting Authority shall not allow the submission of partial tenders in this proceeding. It is the next proceeding under the year-long plan of procurement procedures for similar deliveries, i.e. procurement of Oracle licences. The absence of additional breakdown of this contract into parts shall not prejudice the principles of fair competition and equal treatment of the Contractors. It is also irreble for the possibility of SME sector obtaining this order. Authorized entities for the sale of a manufacturer's license under a specific channel are entities registered as partners of the manufacturer. The absence of further division of the order into parts is an objective circumstance, resulting from the nature of the contract.

4. The Contracting Authority does not require the execution of the contract by protected work establishments, social cooperatives or other contractors subject to the provision of Article 94 (1) of the Law of Public Procurement, hereinafter referred to as the “Act”.

5.The Contracting Authority does not require employment of persons on the basis of employment.

6. The Contracting Authority does not provide for the possibility of awarding contracts referred to in point 8 of Article 214 (1) of the Act.

7. The Contracting Authority shall not permit the submission of variant tenders.

8. The Awarding Entity does not envisage conducting an electronic auction.

9. The Contracting Authority did not conduct preliminary market consultations prior to the initiation of the procedure.

10. The Contracting Authority in this proceeding does not require the Contractors to submit the measures of evidence in question.

11. The Contracting Authority, within the limits laid down by Articles 462 and the following Act, permits the possibility of carrying out the subject of the contract by the Contractor using subcontractors. The Contractor who intends to entrust the execution of part of the contract to subcontractors shall indicate in the offer the parts of the contract to be entrusted to the subcontractors and shall specify the names of possible subcontractors if they are already known.

12. The qualitative requirements referred to in Article 246 (2) of the Act, the Contracting Authority described in detail in section 1 of the template of the contract, as set out in Annex 7 to the SWZ.

13. The Contractor shall, before the expiry of the deadline for the submission of tenders, submit a defect of PLN 30 000,00 and keep them uninterrupted until the date of the deadline for the submission of tenders, except in cases,

referred to in points 2 and (3) of Article 98 (1) and (2) of the Act. Details of the entry of the defect are described in paragraph 13 of SWZ.
