The contractor may entrust the implementation of elements (parts) of the subject matter of the contract to subcontractors. If the contractor intends to perform the subject matter of the contract with the participation of subcontractors, the contractor is obliged to indicate in its offer the parts of the contract (material scopes) which it intends to entrust to subcontractors, and to provide the names of any subcontractors, if they are already known. Such an indication should be placed on the Offer. If no subcontracting is indicated in the Offer, the Contractor will be able to introduce a subcontractor only under the conditions specified in the contract. Pursuant to Article 95 of the Public Procurement Law, the Contracting Authority requires the Contractor or subcontractor to employ persons performing activities related to the performance of the contract consisting in obtaining and harvesting wood raw material, if the performance of these activities involves the performance of work in the manner specified in Article 22 § 1 of the Act of 26.06.1974 – the Labour Code. The Contracting Authority provides for the possibility of awarding contracts referred to in Article 214(1)(7) of the Public Procurement Law within 3 years from the date of awarding the basic contract. The material scope of the services being the subject of the contracts referred to in Article 214(1)(7) of the Public Procurement Law shall not exceed the value of 50% of the value of this contract. Package IX – forestry: JaworzecThe subject of the contract are services in the field of forest management in accordance with Article 6(1)(1) of the Forest Act of 28.09.1991, including works in the field of forest cultivation and protection, timber harvesting and harvesting, and tourist development to be performed in the Cisna Forest District in 2024. The material scope of the subject matter of the contract includes the total quantities of works in the field of forest breeding and protection, timber harvesting and harvesting as well as tourist development resulting from Appendix No. 2 to the Terms of Reference, which consists of: Appendix No. 2.1 – planned size of works; Appendix 2.2 - detailed size of work by groups of activities, activities and locations; Annex 2.3.1 – Forestry characteristics in terms of timber harvesting; Appendix No. 2.3.2 – assortment system of timber harvesting in forestry; Appendix No. 2.3.3 – summary of distances and conditions of wood harvesting; Appendix No. 2.3.4 – list of items with additional difficulties in terms of acquisition and skidding; Appendix 2.3.5 – list of items not available for machine acquisition; Appendix No. 2.3.6 – information on the optimal technology of timber harvesting (potential); Appendix No. 2.4.1. - information on the nature of forest care (weed mowing zones); Appendix No. 2.4.2 - list of items not available for renewal with the planter. The material scopes listed in the appendices included in Appendix 2 are estimates. Quality standards relating to all essential features of the subject matter of the contract are specified in Appendix No. 3 to the Terms of Reference, which consists of: Appendix No. 3.1. - "Description of the standard of forestry work execution technology"; Appendix No. 3.2.-Description of the standard of forestry work execution technology in the Regional Directorate of State Forests in Krosno adopted by Decision No. 25 of the Director of the Regional Directorate of State Forests in Krosno of June 15, 2023 on the implementation of the "Description of the standard of forest works execution technology". Descriptions of the codes of activities describing individual forestry works (activities) included in the subject matter of the contract have been described and a description of the rules of the procedure for the acceptance of forestry works has been included in Appendix No. 3 to the Terms of Reference.
