1.A detailed description and scope of the subject of the contract can be found in Annexes 9, 9a and 9b to the SWZ, each containing 8 sheets for the years 2024-2031.
2. The Contractor is obliged to perform the subject of the contract taking into account the Draft Provisions of the Agreement specified in the Essential Provisions of the Agreement, which constitutes Annex No. 1 to the SWZ.
3. The total estimated demand (basic order + option) for the supply of electricity is 14 129 640 kWh in the period of implementation of the subject of the contract, i.e. from 01.01.2024 to 31.12.2031.

2. The Contractor is obliged to perform the subject of the contract taking into account the Draft Provisions of the Agreement specified in the Essential Provisions of the Agreement, which constitutes Annex No. 1 to the SWZ.
3.Electricity will be supplied in accordance with applicable regulations, in particular on the terms set out in the provisions of the Energy Law Act of 10 April 1997 (Journal of Laws of 2022, item 1385, as amended), together with executive regulations to this Act and the Distribution Network Operation and Operation Manual (IRiESD) of the relevant Distribution System Operator, i.e. Energa Operator SA, Marynarki Polskiej 130, 80-557 Gdańsk and the Act on Renewable Energy Sources (Journal of Laws of 2023, i.e., item 1436) (RES).
4. The Contractor shall supply electricity in accordance with the applicable quality standards of customer service, specified in executive acts issued on the basis of the Act of 10 April 1997 - Energy Law (Journal of Laws of 2022, item 1385, as amended) and the Act of 20 February 2015 on renewable energy sources (Journal of Laws of 2023, i.e., item 1436).
5. The list of organizational units and entities on behalf of and for the benefit of which the Contracting Authority acts is included in Appendix No. 10 to the SWZ.
6. This contract covers the supply of electricity entirely from renewable energy sources.
7. Pursuant to Article 31(1) of the Public Procurement Law, the Contracting Authority provides for a right of option, which is defined as follows:
1) 12 286 640 kWh will constitute the basic order, including 1 535 830 in 2024 and 1 535 830 kWh in each subsequent year, counting up to and including 2031,
2) 15% of the basic contract in each year will constitute a contract covered by the option right, i.e. 1 843 000 kWh in total, including 230 375 kWh in 2024 and 230 375 kWh in each subsequent year up to and including 2031.
8. The Ordering Party declares that the planned demand for electricity for each electricity consumption point is specified in Annexes 9, 9a and 9b to the SWZ containing sheets for the years 2024-2031. The quantity constituting the basic order is the estimated value for each of the electricity consumption points, with due diligence based on the actual actual electricity consumption to date. The above data are informative, serve only to calculate the price of the offer and may not be the basis for any claims on the part of the Contractor. The Contractor's remuneration will be calculated according to the unit prices specified in the offer and the actual consumption of electricity at individual consumption points.
9. The total estimated demand (basic order + option) for the supply of electricity is 14 129 640 kWh in the period of implementation of the subject of the contract, i.e. from 01.01.2024 to 31.12.2031.
10. The Contractor shall be obliged to act as an entity responsible for commercial balancing for electricity sold under the subject of the contract.
