Description:
Collection and management of municipal waste from the Bierzwnik commune in the period from 1.7.2020 to 31.12.2021.

The subject of the contract is the provision of services consisting in the collection and management of municipal waste from all owners of residential and uninhabited real estate as well as real estate on which summer houses and other real estate are used only for part of the year for recreational and leisure purposes, on which municipal waste located in the area Bierzwnik commune in the period 1.7.2020–31.12.2021. (including equipping and supplementing the property with bags for selective waste collection, proper labeling of containers, operation and service of the Municipal Hazardous and Problem Waste Collection Point, collection and management of used batteries and accumulators, expired drugs and medicine packaging, delivery of at least 20 containers for waste (120 l) and at least 3 containers of 1 100 l. A detailed description of the subject of the order is included in Annex 1 to the ToR, hereinafter referred to as OPZ.

2.1. The subject of the contract is the provision of services consisting in the collection and management of municipal waste from all owners of residential and uninhabited real estate as well as real estate on which summer houses and other real estate are used only for part of the year for recreational and leisure purposes on which municipal waste located in the commune Bierzwnik.

2.2. Equipping and supplementing real estate with bags for selective waste collection, in which waste is collected after each waste collection.

2.3. Appropriate marking of containers for selective collection with inscriptions or stickers with inscriptions on the type of waste collected and keeping them in proper order and sanitary condition.

2.4. Operation and service of the Municipal Hazardous and Problem Waste Collection Point, hereinafter referred to as GPZONiP located at ul. Cistercians in Bierzwnik.

2.5. Collection and management of used batteries and accumulators, expired medicines and medicine packaging (collected in containers owned by the Contractor and located in the collection points selected by the Employer).

2.6. Keeping reports and documentation related to the activities covered by the contract during the contract period.

2.7. Delivering a minimum of 20 waste containers with a capacity of 120 liters and a minimum of 3 containers with capacity 1,100 l, including: yellow (min. 1 piece), green (min. 1 piece) and blue (min. 1 piece) to the Ordering Party (new or used containers, standard PN-EN 840).

2.8. A detailed description of the subject of the contract, including a description of the requirements for containers, the frequency of collections, is contained in Annex 1 to the ToR, hereinafter referred to as OPZ.

2.9. Subcontractors.

The contracting authority allows the use of subcontractors. The Contractor:

1) is obliged to indicate in the tender form the parts of the order which it intends to entrust to subcontractors and provide the companies (designation of the enterprise) of the subcontractors and complete section D of Part II of the EAT form. If the Contractor does not intend to perform the contract with the participation of subcontractors, enter "not applicable" or other similar wording. If the Contractor leaves points in the forms empty, the Awarding Entity will consider that the order will be carried out by its own means, without the participation of Subcontractors.

2.9. Pursuant to the content of art. 29 paragraph 3a of the Public Procurement Law, the Employer requires employment under an employment contract within the meaning of the provisions of the Act of 26 June 1974 - Labor Code (i.e. Journal of Laws of 2019, item 1040, as amended) by the Contractor or subcontractors or further subcontractors of persons performing work in the manner specified in art. 22 § 1 of the aforementioned Act. The contracting authority requires employment on the basis of an employment contract, persons performing all services related to the subject of the contract (actually related to waste collection). The above requirement does not apply to persons who perform the above-mentioned activities as part of their business activities. The contractor or subcontractor / further subcontractor will be required to attach to each invoice a statement confirming that the employees performing the above-mentioned works were employed under a contract of employment, indicating their number in the period covering the given invoice. Detailed rules regarding documentation of employment on the basis of an employment contract and sanctions in this respect are set out in the model contract (annex to the ToR) and chapter 21 of the ToR.
