The subject of the order is the delivery of electricity in the period from 1.1.2020 to 30.6.2021 to 1,005 collection points (PPE) with a total estimated volume (± 10%) of 22 556.96 MWh, of which:
1) For premises and facilities (Part 1 of the contract) - 20,908.96 MWh - a detailed PPE list is attached as Annex 1a to the Terms of Reference
Deliveries in the period from 1.1.2020 - 30.6.2021.
2) For the needs of road lighting (Part 2 of the contract) - 1 648.00 MWh - a detailed list of PPE constitutes Annex 1b to the Terms of Reference
Deliveries in the period from 1.7.2020 - 30.6.2021.
The above-indicated forecasted energy consumption is indicative and may differ from the actual energy consumed during the contract period. Decreasing or increasing the amount of energy consumed does not entail any consequences for the ordering party (recipients), except for the need to pay for the actually collected energy according to the rates specified in the concluded contract.

2. Quality standards: the subject of the order is the delivery of electricity with specified quality standards in accordance with applicable regulations. The quality standards for electricity are described in the Act of 10.4.1997 - Energy Law and in the Regulation of the Minister of Economy of 4.5.2007 on detailed conditions for the operation of the power system (Journal of Laws from 2007 No. 93, item 623, as amended). The principles of shaping and calculating tariffs and settlements in trading in electricity are specified in the Regulation of the Minister of Energy of 6.3.2019 (Journal of Laws of 2019, item 503, as amended).
5. The distribution services will be provided on the basis of separate agreements concluded between the ordering parties (electricity recipients - hereinafter "Recipients") and the distribution system operator (DSO).
6. Distribution system operator - as described in Attachment No. 1a / 1b to the ToR, column "Distribution System Operator". The Contractor, on the basis of the Power of Attorney granted, will be obliged to submit on their own behalf and ordering (recipients) contracts for the sale of electricity to the relevant DSO in accordance with applicable regulations.
Note: The Contractor will notify the collection points only on the basis of the data (to be changed (after conclusion of the contract for the sale of electricity) by the orderer or his representative to change the seller. The condition for commencing the electricity supply in the indicated (in relation to individual collection points) time is a positive procedure for changing the seller, the recipient has a valid agreement for the provision of electricity distribution services and effective termination / expiration of existing contracts for the sale of electricity / comprehensive contracts:
1) In the case of comprehensive or unlimited contracts for the sale of electricity, ordering parties (recipients) will submit (with reference to individual collection points) appropriate declarations of termination of contracts with effect on the day preceding the planned delivery start date (as described in 1a / 1b to The SIWZ column "Delivery period"), and copies of the notices will be forwarded to the contractor, whose offer will be considered the most advantageous.
2) In case of having timely sales contracts, their term expires on the day preceding the planned date of commencement of delivery (as described in Annex 1a / 1b to the ToR, column "Delivery period"). In Annex No. 1a / 1b, the column "Change of seller" indicates for which PPE the change of seller will occur for the first time and for which the seller is the next time. In the case of collection points, in which the distribution of sales and distribution contracts has already occurred (another change of seller), the ordering parties (recipients) have distribution agreements concluded for an indefinite period, in the case of collection points for which the change of seller takes place for the first time (and are currently in force comprehensive contracts), the contractor will be required to submit on behalf of the contracting authority required by the DSO.
A detailed description of the collection points (PPE) is provided by the awarding entity in Appendix No. 1b to the ToR.
3. Estimated electricity consumption during the contract period (± 10%) 1 648.00 MWh, of which:
Zone I 423.96 MWh
Zone II 1.224,04 MWh
Zone III 0.00 MWh
The above data is indicative. The contractor should take into account possible fluctuations in electricity consumption.
4. Deliveries will take place from 1.7.2020 to 30.6.2021, with the reservation that the details of delivery times (start and end) for individual collection points are described in Annex No. 1b column "Delivery period" .
5. Current contracts for the supply of electricity will expire or will be terminated with effect on the day preceding the planned date of commencement of delivery (column "Delivery period"). The obligation to terminate contracts lies with the ordering parties (recipients).
The electricity supply will take place in the period from 1.1.2020 to 30.6.2021, whereby:
1. Deliveries under part 1 of the contract will be implemented in the period from 1.1.2020 to 30.6.2021.
2. Deliveries under Part 2 will be executed from 1.7.2020 to 30.6.2021.
Subject to the fact that details regarding the delivery period (start / end) to individual collection points are described in Annex No. 1a / 1b to the ToR, column "Delivery period"
The condition for starting deliveries within the dates indicated in Annex No. 1a / 1b is the effective procedure of changing the seller.
