The subject of the order is air services consisting of air extinguishing fires in the forest and its immediate vicinity for the Regional Directorate of State Forests in Łódź. Aircraft stationing site: Forest Air Base Piotrków Trybunalski. It is envisaged to complete the order using 1 aircraft and 40 flight hours.
1. Detailed rules for the provision of services are defined by the model of the contract — Annex 7 to the SIWZ.
2. The Contracting Authority shall require employment by the contractor or subcontractor on the basis of the working relationship of persons performing the activities part of the subject of the contract involving the piloting of aircraft, if the performance of such activities consists in the performance of the work in the manner laid down in Article 22 § 1 of the Act of 26 June 1974 — Labor Code (Journal of Laws of 2020 item 1320 as amended).
3. The Contracting Authority shall not reserve the obligation of the contractor to perform the key tasks concerning the subject of the contract. The Contractor may entrust the execution of elements (parts) of the object of the contract to subcontractors In the event of an intention to perform the subject of a contract involving subcontractors, the contractor shall indicate in his tender the parts of the contract (tangible ranges) the execution of which he intends to entrust to subcontractors and the names of possible subcontractors if they are already known. This indication should be placed on the Offer. In the absence of an indication in the subcontracting offer, the contractor will be able to introduce the subcontractor only after the prior consent of the contracting operator.
4. The Contracting Authority is entitled to order the contractor an additional material range including the same (analogous) activities as described in the description of the subject of the order ('option'). The subject of the option will be additional flight hours, as described in SWZ (and priced by the contractor on offer). The Contracting Authority is not obliged to order the works covered by the option, and the contractor is not used to claim their commission. The work subject to the option may be contracted in a quantity of 30 hours of flights. The basis for determining the value of the works commissioned under the option (to determine its scope) will be the unit prices per flight hour included in the offer.
5. The Contracting Authority provides for the possibility of exercising the option if there is a need to increase the scope of in-kind services under contract due to unpredictable phenomena in the form of forest fire.
6. The Contracting Authority provides for the possibility of awarding the contracts referred to in point 7 of Article 214 (1) of the Pzp within 3 years of the award of the basic contract.
7. The contracts referred to in point 6 shall consist of the repetition of services compatible with the services which are subject to this contract and the services similar to them in the technological aspect of their implementation. The scope of the services which are the subject of the contracts referred to in point 6 shall be covered by air services involving the extinguishing of fires in the forest and its immediate vicinity.
8. The scope of in-kind services which are the subject of the contracts referred to in point 6 shall not exceed 50% of this order.
9. The contracts referred to in point 6 shall be awarded after a separate procedure for the award of a public contract by free hand.
10. The contracts referred to in point 6 shall be awarded if there is a need to increase the scope of in-kind services under contract due to unpredictable phenomena in the form of forest fire, as well as in the absence of the possibility of emergence from the reasons for objective air service contractors in the framework of basic procurement modes, in order to secure the necessary performance of those services and in the case of entrusting the contractor to the work carried out by another contractor.
