The subject of the contract are services entitled: "Collection of municipal waste from the area of the Sulików Commune".

1) The subject of the contract are services entitled: "Collection of municipal waste from the area of the Sulików Commune", the scope of which includes in particular:

a. collection of non-segregated (mixed) municipal waste from inhabited and uninhabited properties,

b. providing property owners with the possibility of renting (or putting into another form of use) containers for collecting non-segregated (mixed) municipal waste,

c. organization of selective collection of waste: paper and cardboard, metals, plastics, multi-material packaging, glass, in a collective system,

d. organization of selective collection of waste: paper and cardboard, metals, plastics, multi-material packaging, glass in an individual system,

e. organization of selective collection of bio-waste in an individual system,

f. collection once a year, with the exception of 2023, of furniture and other bulky waste, displayed in each locality of the commune in the form of the so-called "exhibition",

g. collection of construction and demolition waste in an individual system,

h. operation and organization of the Selective Municipal Waste Collection Point (PSZOK),

i. delivery of all municipal waste collected from the Sulików Commune to the Municipal Installation in Lubań,

j. development of a schedule for municipal waste collection,

k. keeping documentation related to the activity covered by the subject of the contract.

2) A detailed description of the subject of the contract was included in the draft agreement constituting Annex 6 to the SWZ and annexes to the draft contract, which include:

a. List of properties covered by the subject of the contract,

b. List of places where containers for selective waste collection are set up in the collective system,

c. Parameters and designation of containers for selective waste collection.

3) All requirements specified in the documents indicated above are minimum requirements, and their fulfillment is obligatory. Failure to meet the above-mentioned minimum requirements will result in the rejection of the offer as inconsistent with the terms of the contract pursuant to Article 226(1)(5) of the PPL.

4) The estimated amount of municipal waste collected from inhabited and uninhabited properties constitutes Annex 1 to the SWZ. This amount was determined on the basis of data submitted to the Sulików Commune Office in the annual reports of the entity collecting municipal waste from property owners. The indicated quantity should be considered as indicative. The Contractor is not entitled to compensation for failure to reach the indicated quantity.

5) Definitions relevant to the implementation of the subject of the contract:

a. Municipal Installation – For the purposes of this SWZ, a municipal installation is an installation for the processing of non-segregated (mixed) municipal waste or residues from the processing of such waste within the meaning of the Act of 14 December 2012 on waste (Journal of Laws of 2023, item 295, as amended) – in the case of the present proceedings, it is the Waste Utilization Centre of the Lusatian Municipalities in Lubań, Bazaltowa 1, 59-800 Lubań.

b. PSZOK - For the purposes of this SWZ, the Point of Selective Municipal Waste Collection within the meaning of the Act of 13 September 1996 on maintaining cleanliness and order in municipalities (Journal of Laws of 2022, item 2519, as amended) is considered to be PSZOK.
