The subject of the contract is the delivery of one low-emission hybrid bus for Zakład Komunikacji Publicznu Suchy Las Sp. z o. o. with its registered office in Chludów at 8 Tysiąclecia Street - with technical and functional parameters specified in the description of the subject of the contract, which is attached as Annex 1 to SWZ. The offered bus must have a homologation allowing the vehicle to be used in the Republic of Poland, which will be required at the stage of contract implementation.

1) The subject of the contract is the delivery of one low-emission hybrid bus for Zakład Komunikacji Publicznu Suchy Las Sp. z o. o. with its registered office in Chludów at Tysiąclecia 8 Street - with technical and functional parameters specified in the description of the subject of the contract, which constitutes Annex 1 to SWZ. The offered bus must have a homologation allowing the vehicle to be used in the Republic of Poland, which will be required at the stage of contract implementation.

2) The bus offered by the Contractor must be brand new – as defined in the Road Traffic Act of 20 June 1997 (i.e. – Journal of Laws of 2022, item 988, as amended), have a current EC vehicle type-approval certificate issued in accordance with the Regulation of the Minister of Transport, Construction and Maritime Economy of 25 June 2013 on type-approval of motor vehicles and trailers and their items of equipment or parts (Journal of Laws of 2015, item 1475 from as amended) and meet the requirements resulting from the exhaust emission standard of at least Euro 6. The Ordering Party requires that the offered type of bus is not a prototype, i.e. that it is in the offer for sale no later than on the day of submitting offers.

3) Used by the Ordering Party, in the description of the subject of the contract, to designate materials, devices, software, licenses, technical systems and other elements of description: trademarks, patents or origin, sources or a specific process that characterizes the products or services provided by a specific contractor referred to in Article 99 paragraph 4 of the Act and standards, European technical assessments, approvals, technical specifications and technical reference systems referred to in Article 101 paragraph. 4 acts - hereinafter collectively referred to as "restrictive formulations" constitute only a qualitative, functional, technical, technological or aesthetic model and in all cases of their use it is allowed to use materials, devices, software, licenses, technical systems and other equivalent elements, hereinafter referred to as "equivalent solutions". Specified materials, devices, software, licences, technical systems and other elements of description by means of 'restrictive wording' may be replaced by equivalent solutions with not inferior quality, functional, technical, technological or aesthetic characteristics, taking into account correct cooperation and compatibility. The use of "restrictive wording" is not intended to give preference to a given manufacturer or his product, but only serves to indicate a solution that should have features not inferior to those given in the description of the subject of the contract – Appendix No. 1 to the SWZ. In the case of tenders containing equivalent solutions, the Contracting Authority will verify them in terms of meeting the requirements of individual items of technical requirements contained in Annex 1 to the SWZ. The Contractor is obliged to prove in the offer the equivalence of the offered materials, devices, software, licenses and technical systems. The Ordering Party shall not recognize equivalent solutions if they are of worse quality, functional, technical, technological or aesthetic properties than those indicated in Appendix No. 1 to the SWZ.
