The subject of the contract is the implementation of a winter maintenance vehicle monitoring system based on GPS technology in the winter season 2022/2023 in the City of Łódź.

(Numbering in accordance with SWZ): 4.1 The subject of the contract is the implementation of a winter maintenance vehicle monitoring system based on GPS technology in the winter season 2022/2023 in the City of Łódź.

4.2 The scope of the contract includes, m.in:

4.2.1 delivery and installation of 16 customer applications, 16 sets (login and password) enabling access to the system via the web application and equipment used directly to coordinate and supervise winter road maintenance in the city of Łódź using the delivered applications;

4.2.2 installation of GPS devices and ploughing and sprinkling sensors on 97 vehicles in companies providing winter maintenance services, and performing an inspection with maintenance of installed devices in the winter season 2022/2023;

4.2.3 use of complete GPS devices and ploughing and sprinkling sensors on 97 vehicles (the service includes the winter season 2022/2023);

4.2.4 GPS and video telematics service (the service includes the winter season 2022/2023);

4.2.5 dismantling of GPS devices and ploughing and sprinkling sensors on 97 vehicles in companies providing winter maintenance services (the service includes the winter season 2022/2023).

4.3 A detailed description of the subject of the contract can be found in Appendix No. 1 to the SWZ and in the model contract (Appendix No. 6 to the SWZ).

Deadline for the performance of the contract – from the date of conclusion of the contract to 30.05.2023

The implementation of the subject of the contract will be divided into five consecutive stages:

1) Stage I - within 14 days from the date of conclusion of the contract;

2) Stage II - by 30.12.2022 or up to 10 days from the date of the written order for the installation of GPS devices and ploughing and sprinkling sensors on vehicles indicated by the Ordering Party;

3) Stage III - from 15.12.2022 to 31.03.2023;

4) Stage IV - from 15.12.2022 to 30.04.2023;

5) Stage V - will take place within the period indicated by the Ordering Party and may not exceed a total of 14 calendar days from the date of the written order by the Ordering Party, but no later than until 30.05.2023.

33.1 Pursuant to Article 95 of the Public Procurement Law, the Contracting Authority requires the Contractor or Subcontractor to employ persons performing the activities indicated by the Ordering Party in the scope of the contract, if the performance of these activities consists in performing work in the manner specified in Article 22 §1 of the Act of 26 June 1974 – Labour Code (Journal of Laws of 2020, item 1320). i.e. the activities of an employee performing directly works related to the assembly and disassembly of GPS devices, GPS and video telematics service, technical support service for the proper functioning of devices and operation of the IT application.

33.2 The type of activities related to the performance of the contract and the method of verifying the employment of these persons and the Ordering Party's right to control the Contractor's compliance with the requirements related to the employment of these persons and sanctions for non-compliance with them are specified in the description of the subject of the contract (Annex No. 1 to the SWZ) and in the model contract (Annex No. 6 to the SWZ).

3.4 The Ordering Party does not provide for an electronic auction.

The contracting authority does not envisage the conclusion of a framework agreement.

8.3 Information for Contractors jointly applying for a contract award (e.g. consortium, civil partnerships)

8.3.1 The Contracting Authority in relation to Contractors jointly applying for the award of a contract in relation to the condition regarding technical or professional ability allows the contractors to meet the condition jointly.

8.3.2 The fulfillment of the conditions for participation in the proceedings by Contractors jointly applying for the award of the contract will be verified by the Contracting Authority in accordance with Article 117 (3) of the Polish Law.

8.3.3 Contractors jointly applying for the award of a contract, together with the offer, submit a statement from which it follows which scope of the subject of the contract will be performed by individual Contractors. This statement is attached as Appendix No. 8 to the SWZ.
