The subject of the contract is the delivery of a server with a matrix as part of the "Infostrada Kujawy i Pomorza 2.0" project as part of Stage II – equipping Partners with equipment for use as part of the City Platform. The subject of the contract is specified in detail in Annex 1 to the SWZ – Description of the subject of the contract.
The Contracting Authority requires the Contractors submitting the offer to pay a bid bond before the deadline for submitting bids in the amount of PLN 14,000.00 (fourteen thousand PLN).
If the bid bond is not paid or the bid bond is not improperly lodged or the bid bond is not maintained continuously until the expiry of the bid validity period or if an application for the return of the bid bond is submitted in the case referred to in Article 98(2)(3) of the PPL, the Contractor's bid will be rejected from the procurement procedure.
The Contractor deposits in money by transfer to the bank account of the Ordering Party - Bank PKO BP SA number 31 1020 5040 0000 6902 0085 9652.

2.The subject of the contract is specified in detail in Annex 1 to the SWZ – Description of the subject of the contract.
3.The Contracting Authority requires that the data provided by the Contractor, in Annex nr2.1.do SWZ – Offer Form – detailed part, clearly and precisely indicate the subject of the contract. The data provided must allow the Ordering Party to unambiguously identify the subject of the contract in terms of configuration in accordance with the requirements of the Ordering Party using generally available methods (e.g. manufacturer's website) in order to check the correctness of its parameters with the requirements of the SWZ. If the model or name of the subject of the contract provided by the Contractor does not fully reflect the fulfillment of the Ordering Party's requirements, technical data in terms of configuration and accessories of the object should be indicated.
4.The Ordering Party allows offering the subject of the contract with parameters exceeding the requirements of the Ordering Party, with modern technological requirements, meeting at least the minimum requirements set out in Annex 1 to the SWZ and not worse in terms of quality and technical conditions, while maintaining its appropriate functionality and purpose.
5.The Contracting Authority informs that in accordance with Article 101 paragraph 4 of the Public Procurement Law, if the description of the subject of the contract includes a reference to standards, technical assessments, technical specifications and technical reference systems referred to in Article 101 paragraph 1 point 2 and paragraph 3, the Contracting Authority allows solutions equivalent to those described.
6. Warranty and service:
1) 3 years warranty and service of the matrix manufacturer with the delivery time of spare parts on the next business day,
2) 3 years warranty and service of the server manufacturer with the delivery time of spare parts on the next business day,
3) Access to the service center 24/7,
4) Ability to report failures 24/7,
5) 3 years of software updates and access to the manufacturer's service portal, access to knowledge and technical information about the offered device.
7. A detailed description of the conditions for the implementation of the subject of the contract is included in the Model Agreement constituting Annex 3 to the SWZ.
1.The Contracting Authority provides for the possibility of amendments to the content of the contract concluded in relation to the content of the offer on the basis of which the Contractor was selected as follows:
1) changes in generally applicable law or resulting from final judgments or final administrative acts of competent authorities - to the extent that it will be necessary to adapt the provisions of the contract to the existing legal or factual status;
2) occurrence of force majeure – understood as the occurrence of an extraordinary, external, unpredictable and preventable event, which could not be avoided even with the utmost care, and which allows the Contractor to perform its obligation in whole or in part. In the event of force majeure, the Parties to this contract shall make every effort to minimise delays in the performance of their contractual obligations as a result of force majeure;
3) change the subject of the contract to the subject of the contract with equal or higher parameters while maintaining the prices indicated in the contract, provided that the Contractor submits such a request to the Contracting Authority and proves that there were circumstances beyond its control, which – acting with due diligence – could not foresee, and the newly proposed subject of the contract meets the requirements of the Contracting Entity.
2.Making the above-mentioned changes requires, under pain of nullity, the written form (annex) and a written request of one of the Parties for change with justification.
