The subject of the contract is a comprehensive supply of high-methane natural gas with the symbol E, including the sale and distribution of gas to the units of the Nowy Targ City Municipality in the period from January 1, 2023 to December 31, 2023.

2. Details of the delivery and the manner in which it was carried out:

1/ the scope of the contract includes the sale and distribution of gas in the quantity of:

a) for the first part of the order approximately 1 938 889,00 kWh,

b) for the second part of the order approximately 511 445,00 kWh

2/ estimated gas consumption in the above-mentioned period, contractual capacity, gas tariffs for individual facilities and their gas characteristics have been indicated in the list, which will constitute Annex 2 to the tender specifications,

2. Details of the delivery and the manner in which it was carried out:

1/ the scope of the contract includes the sale and distribution of gas in the quantity of:

a) for the first part of the order approximately 1 938 889,00 kWh,

2/ estimated gas consumption in the above-mentioned period, contractual capacity, gas tariffs for individual facilities and their gas characteristics have been indicated in the list, which will constitute Annex 2 to the tender specifications,

3/ the indicated consumption is an estimate and indicative, which serves only to value and then compare offers, and consequently does not constitute an obligation of the contracting authority to purchase gas in the given quantity, which may be increased or decreased during the contract period, and the settlement will be based on the actual gas consumption in the facility, in accordance with the meter indications,

4/ the number of gas collection points may change, changes will be introduced in the form of an annex to the contract,

5/ the natural gas supplied by the contractor must meet the requirements set out in the applicable regulations, in particular the Energy Law (Journal of Laws of 2021, item 716, as amended) and executive acts issued on its basis, as well as other related acts of applicable law and Polish standards,

6/ the contracting authority currently has concluded contracts for the sale and distribution of natural gas in accordance with the schedule of Annex 2 to the specification of the terms of the contract,

7/ after the end of the procedure, the contracting authority will provide the contractor whose offer will be selected with all the data necessary for the contractor to change the seller,

8/ the contracting authority shall grant the contractor an appropriate power of attorney to notify on behalf of the ordering party the concluded contract for the sale of gas to the DSO and to perform the activities necessary to carry out the process of changing the seller at the DSO,

9/ the ordering party has the right during the term of the contract to submit a request for a change in contractual force,

10/ the payment deadline for the implementation of the subject of the order will not be shorter than 14 days from the date of delivery of a properly issued invoice, no more than once a month, with an indication of the point of receipt and the amount of gas consumption and delivery to the recipient's correspondence address (indicated in the contract),

11/ the deadline for delivery to the recipient of a properly issued invoice or VAT invoices shall be fixed not less than 14 days before the payment date specified on the invoice. In the event of non-compliance with this deadline, the payment period indicated in the VAT invoice will automatically be extended by the time of delay,

12/ settlements will take place on the basis of actual gas consumption (the use of planned installments and forecast invoices is excluded) in a given settlement period according to the unit price,

13/ the ordering party for the W-2.1 tariff allows the possibility of settlement via two-month forecast invoices,

14/ the net unit price of natural gas sales is in accordance with the approved tariff by the President of the Energy Regulatory Office for supplies covered by the Act on the Protection of Gaseous Fuel Customers. The net unit price of the sale of natural gas is fixed, except for the possibility of changing it in the case of: approval by the President of the Energy Regulatory Office of a new tariff for supplies covered by the Act on the Protection of Gas Fuel Consumers, statutory change in excise duty for the sale of natural gas and the amount of the fixed and variable fee resulting from the approval by the President of the Energy Regulatory Office of the new tariff of the Distribution System Operator,
