The subject of this publication is the conclusion of non-exclusive discount agreements in accordance with § 130a (8) of the German Civil Code V for pharmaceuticals for the following active substances/drug combinations:

1. active substance dienogest/ethinyl estradiol,

2. Active ingredient amifampridine.

All interested and suitable pharmaceutical companies are offered the conclusion of a discount agreement according to §130a paragraph 8 of the German Civil Code V. subject to uniform conditions and a uniform access process. There is no exclusivity. The purchase quantity is unknown when the agreement is concluded and depends in particular on the demand of insured persons, the development of the number of insured persons, on the regulatory behaviour of contracting doctors and the delivery and stocking behaviour of public pharmacies. The client does not guarantee minimum purchase quantities.

Interested pharmaceutical companies can request participation documents (discount agreement, self-declaration on the absence of exclusion reasons, declaration of conformity), stating lot and active substance via the e-mail address specified in I.1). Agreements under this model will be concluded in the period from 17.8.2021 to 30.9.2022. Interested parties must submit the fully completed and signed participation documents (self-declaration on the absence of exclusion reasons, discount agreement in double execution, declaration of conformity) for the first time by August 16, 2021, and then by the 15th of a month, by post to the body mentioned under I.1). It depends on the access of both AOK PLUS. If the 15th of a month falls on a Saturday, Sunday or nationwide public holiday, the next working day takes the place of such a day. If received later (after August 16, 2021 or 15th of a month), the submitted participation documents will be taken into account on the 15th of the following month.

The discount agreement will enter into force on October 1, 2021 upon signing both parties up to and including 30.9.2021. If the date of signing AOK PLUS after September 30, 2021, this discount agreement will enter into force as soon as AOK PLUS has signed the discount agreement upon receipt of the complete documents signed by the pharmaceutical entrepreneur. The signing takes place until the end of the month in which the participation documents must be received by AOK PLUS. In terms of organization, an advance of about half a month is required by AOK PLUS in order to report the discount agreement. The initial labelling of the discount drugs in the pharmacy software takes place from the second month following the deadline for receipt of the participation documents. If the deadlines for the deadline reports are changed or redefined in the nationwide AOK contract reporting portal datraBatt, this time may vary. A discount agreement is concluded with all pharmaceutical entrepreneurs who meet the eligibility requirements and confirm this by signing on the requested documents.

The contract ends no later than September 30, 2022, regardless of the date of conclusion of the contract. AOK PLUS reserves the right to terminate the open house process early, especially in the event of the conclusion of exclusive discount agreements. In this case, the contracts already concluded end in accordance with the contractual provisions. According to the experience of AOK PLUS, exclusive discount agreements usually enter into force 8 to 12 months after the publication of the relevant tender notice in the supplement to the Official Journal of the European Union. Future contractors in the open house model are asked to inform themselves regularly in the supplement to the Official Journal of the European Union.
