The object of the order is the delivery of equipment under the modernization of TVP Entertainment channels, TVP Seriale, TVP Historia, TVP ABC and TV Belsat to HD standard. A detailed description of the subject matter of the order includes Annex 2 to the SWZ, to which the Contracting Authority has granted a confidentiality clause, as the information contained therein constitute a secret of the Contracting Authority.

1.The object of the order is the delivery of equipment under the modernization of TVP Entertainment channels, TVP Seriale, TVP Historia, TVP ABC and TV Belsat to HD standard.

2.A detailed description of the subject matter of the order includes Annex 2 to the SWZ, to which the Contracting Authority has granted a confidentiality clause, as the information contained therein constitute a secret of the Contracting Authority.

3.Submission to the Contractor of Annex 2 to the SWZ will be possible after submission to the Contracting Authority of the Confidentiality Agreement constituting Annex 3 to the SWZ — hereinafter referred to as “NDA” — signed by a person duly empowered to represent the Contractor, which the Contractor is obliged to demonstrate when submitting NDA as indicated in paragraph 4 below. The NDA must be drawn up and communicated in electronic form and bear a qualified electronic signature. The Contracting Authority shall not permit the submission of this document in any other form, e.g. written.

4.Together with the NDA, the Contractor is obliged to provide the Contracting Authority with a document confirming the power to represent the Contractor. Where separate provisions require entry in the register or records, the document shall be appropriate to write down or information from the National Court Register or from the Central Registry and Business Information, or from any other relevant register or document on the basis of which it shall be made an entry in the relevant register or records, e.g. a resolution of the competent authority of the Contractor. Where the Contractor represents the Agent, together with the power of attorney determining its scope, the document referred to in the preceding sentence shall be forwarded. The provisions of paragraphs 9.4-9.5 of SWZ shall apply accordingly.

5.Annex 2 to SWZ, after fulfilling the requirements described in paragraphs 3 and 4 above, will be transmitted to the Contractor in the form of an encrypted file, via the Platform. The password for the encrypted file will be sent to the Contractor on the indicated by the Contractor in NDA mobile phone No.

6. In the event of an application for clarification of the contents of Annex 2 to the SWZ, the Contractor shall be obliged to submit this request through the Platform in the form of an encrypted file. Password for the encrypted file Contractor is obliged to send the Ordering Party on the mobile phone number indicated in the SWZ, according to the following order: the abbreviated name of the Contractor, the password for the encrypted file. The Contracting Authority shall not be liable for the Contractor's failure to complete the above formal requirements and the failure to decrypt the file in order to read the contents of the application for clarification of the contents of Annex 2 to the SWZ.

7. In the case where, in the proceedings, the Contracting Authority shall provide information constituting company secrets or information closely related to the company's secretive information relating to the contents of Annex 2 to the SWZ in order to maintain its confidentiality, they will be posted on the Platform. The information referred to in sentence 1 shall be communicated only to those Contractors to whom the Contracting Authority has forwarded Annex No 2 to the SWZ.
