The object of the contract to be awarded is the conclusion of a framework agreement on IT hardware and IT services for ICT investigation and investigation support for the North Rhine-Westphalia police (Lot 1: Intel PCs, workstations and services; Lot 2: Apple products and services).

The client is the State Office for Central Police Services North Rhine-Westphalia. In North Rhine-Westphalia, the police carry out their tasks in 47 district police authorities and three higher state authorities (LOB) with around 50,000 employees.

The State Office for Central Police Services NRW ("LZPD NRW") supports local police work within the NRW police force by developing and procuring state-of-the-art technology and equipment. In particular, the LZPD NRW is the central service partner for all operational matters relating to the IT infrastructure of the NRW police. The specialist applications are available nationwide to all police officers in one of the world's largest domain structures. The LZPD NRW offers more than 100 central police-specific IT solutions for all police authorities. The further development of this complex application landscape takes place regularly via so-called state projects with budget sizes in the multi-digit millions.

The Ministry of the Interior of the State of North Rhine-Westphalia commissioned the LZPD NRW with the definition of standards for hardware of the "IuK-E" (Information and Communication Technology Investigation) and "IuK-EU" (Information and Communication Technology Investigation Support) for the departments.

In order to describe these standards, the LZPD NRW in close cooperation with the LKA NRW annually determines or updates the actual requirements.

At the workshop, which usually takes place annually in December for this purpose, the experience of the ICT-E/EU services with the hardware used so far (manufacturers, models, types, compatibilities) is queried and used as a future basis for the uniform determination of the ICT-E/EU equipment. If new developments and technical possibilities are relevant, the cost-effectiveness of inclusion in the standards of ICT-E/EU equipment is examined. The results of the workshop will be laid down in a legally binding list.

Due to technical innovations, the LZPD therefore requires IT hardware (clients and laptops) and various associated IT services (including "immediate" repair on the premises of the client, hotline for fault reports, collection and disposal of electronic waste and packaging, WebShop / E-Portal / electronic shopping cart for processing orders of the individual departments) for ICT investigation and investigation support.

Therefore, a framework agreement for the procurement of high-performance PCs as well as the associated service, guarantee and warranty is to be concluded. It is in particular. to the following products: IuK-/EU-PC INTEL, Workstation IT-EU (complete PC), Mobile Workstation IT-EU and notebook training computer cybercrime, as well as various optional components (e.g. SSD 2 TB SATAIII 6 - 6 Gb/s 2.5 inch, EXSYS IDE 2HDD PCIe controller, Sharkoon HDD Station SATA Quickport DUO USB 3.0 and Tableau Forensic Universal Bridge T356789iu).

The total maximum value of the order, which is designed as a framework agreement with individual call-offs, amounts to EUR 10,080,000.00 (net). This setting of a maximum value takes place against the background of the case law of the ECJ of 17.06.2021, Case C-23/20, according to which contracting authorities are obliged to indicate the maximum value of the services to be provided under a framework agreement. In this sense, the maximum value stated here is to be understood as deviating from the estimated value in order to secure the customer quantitatively even in the event of currently unforeseeable performance peaks, without a purchase obligation resulting from the maximum values stated here. The estimation of the contract value is also based on the upper range of the marketable pricing according to the experience of the client - precisely pursuing this hedging objective of covering even unpredictably large requirements of the client relating to the services subject to the award within the term.

For this purpose, in addition to the sale of hardware and the corresponding service provision, the contractor will comprehensively advise and support the LZPD with regard to the technical design and implementation of the requirements of the North Rhine-Westphalia police.
